5 2. The failure to keep the property clear of junk, trash, household items and other refuse is a violation of EMC 8.20.020. The code requires that such items be kept off of the property or in proper storage. 3. Such violations are an annoyance and disrupt and injure the comfort, repose, health and safety of others. This violation is a public nuisance. ORDER Based on the Findings of Fact and Conclusions of Law as stated above, it is hereby determined that a default judgment is entered and the Respondent is in violation of IPMC 108.1.5, and EMC 8.20.020(A)(C)(G) and is hereby ordered to: 1. The Respondent shall abate all violations of IPMC 108.1.5 as adopted by EMC 16.005.010 unsecured structure creating an attractive nuisance to children and harbor potential criminal activity, EMC 8.20.020(A)(C)(G)junk, trash, discarded household equipment and items of personal property. 2. All abatement of the violations of IPMC 108.1.5 on the above mentioned property shall be completed by February 22, 2013. Cleanup and abatement shall include: a. The Respondent shall vacate the residence and properly securing it from entry, until such time that it has been approved for occupancy by City of Everett Building Department. 3. All abatement of the violations of EMC 8.20.020(A)(C)(G) on the above mentioned property shall be completed by February 22, 2013. Cleanup and abatement shall include: a. The Respondent shall remove and either properly dispose of or properly store all junk, trash, debris and items of personal property that are present on the property in view of the public street or adjacent properties. 4. The Respondent shall pay$500.00 for each violation of IPMC 108.1.5 as adopted by EMC 16.005.010 and EMC 8.20.020(A)(C)(G)for a total fine of$1000.00. 5. The Respondent shall not violate any ordinance set forth in EMC §1.20.020 or any ordinance or regulation that identifies the enforcement procedure described in Chapter 1.20 EMC as the enforcement procedure for said regulations or ordinance, for the next twenty-four(24) months. 6. The Respondent shall pay the$1,000.00 fine no later than March 8, 2013. Payment shall be made to the City of Everett Treasurer at 2930 Wetmore Suite 100, Everett Washington, 98201. If payment is not made on or before March 8, 2013, collection action will be taken, which may include assigning the debt to a collection agency pursuant to EMC §1.20.050(D).
