5 <br /> 2. The failure to keep the property clear of junk, trash, household items and other <br /> refuse is a violation of EMC 8.20.020. The code requires that such items be kept off <br /> of the property or in proper storage. <br /> 3. Such violations are an annoyance and disrupt and injure the comfort, repose, health <br /> and safety of others. This violation is a public nuisance. <br /> ORDER <br /> Based on the Findings of Fact and Conclusions of Law as stated above, it is hereby <br /> determined that a default judgment is entered and the Respondent is in violation of <br /> IPMC 108.1.5, and EMC 8.20.020(A)(C)(G) and is hereby ordered to: <br /> 1. The Respondent shall abate all violations of IPMC 108.1.5 as adopted by EMC <br /> 16.005.010 unsecured structure creating an attractive nuisance to children and <br /> harbor potential criminal activity, EMC 8.20.020(A)(C)(G)junk, trash, discarded <br /> household equipment and items of personal property. <br /> 2. All abatement of the violations of IPMC 108.1.5 on the above mentioned property <br /> shall be completed by February 22, 2013. Cleanup and abatement shall include: <br /> a. The Respondent shall vacate the residence and properly securing it from entry, <br /> until such time that it has been approved for occupancy by City of Everett <br /> Building Department. <br /> 3. All abatement of the violations of EMC 8.20.020(A)(C)(G) on the above mentioned <br /> property shall be completed by February 22, 2013. Cleanup and abatement shall <br /> include: <br /> a. The Respondent shall remove and either properly dispose of or properly store <br /> all junk, trash, debris and items of personal property that are present on the <br /> property in view of the public street or adjacent properties. <br /> 4. The Respondent shall pay$500.00 for each violation of IPMC 108.1.5 as adopted <br /> by EMC 16.005.010 and EMC 8.20.020(A)(C)(G)for a total fine of$1000.00. <br /> 5. The Respondent shall not violate any ordinance set forth in EMC §1.20.020 or any <br /> ordinance or regulation that identifies the enforcement procedure described in <br /> Chapter 1.20 EMC as the enforcement procedure for said regulations or ordinance, <br /> for the next twenty-four(24) months. <br /> 6. The Respondent shall pay the$1,000.00 fine no later than March 8, 2013. <br /> Payment shall be made to the City of Everett Treasurer at 2930 Wetmore Suite 100, <br /> Everett Washington, 98201. If payment is not made on or before March 8, 2013, <br /> collection action will be taken, which may include assigning the debt to a collection <br /> agency pursuant to EMC §1.20.050(D). <br />
