Ted de Budden <br /> From: Ted de Budden <br /> Sent: Thursday,April 12, 2018 12:13 PM <br /> To: Donald Cunningham <br /> Subject: 3010 Everett Ave <br /> Hello Don, <br /> I have conducted a permit and records search for the building located at 3010 Everett Ave, here is my findings. <br /> A permit to construct this building was issued 11/20/2007. <br /> A Certificate of Occupancy was issued 4/16/2008 <br /> Records indicate that the permitted uses for this structure are for two residential dwelling units (R-2) located on the <br /> second floor of the building,with Office (B) and storage (S-2) uses located on the First floor. <br /> Observations made during the joint inspection conducted with you on 4/10/2018 reveal that the lower portion of the <br /> building has been altered from the original approved office and storage occupancies,to dwelling use and occupancy to <br /> include 5 sleeping rooms,a common kitchen, additional bathroom, laundry area,and common spaces. <br /> Modification of the Electrical, Plumbing, Mechanical systems has occurred,wall construction work has been conducted <br /> to alter this area for residential use. <br /> Permit records indicate that the alteration and modification work to change the use and occupancy of this building has <br /> been made without required permits and approvals. <br /> The unpermitted alteration work has been done in violation of adopted codes. IBC section 105.1 "Permits required" IBC <br /> section 114.1 "Unlawful Acts" <br /> Observation of the altered areas revealed non code compliant features and installations such as exposed and improperly <br /> installed non-metallic wiring, piping, ductwork and ventilation, stairway, railings,thermal insulation etc. Many of these <br /> features were observed to be missing or improperly installed. <br /> Additionally,smoke alarms were observed missing throughout this area and sleeping rooms that lack egress and rescue <br /> openings to the outside. <br /> As you know our observations were limited to the first floor area of the building.The owner of the property stated that <br /> "no alteration of the upper floor area of the structure has occurred",since originally constructed. <br /> The unpermitted alterations and occupancy have been made contrary to law,this building is an Unlawful Structure as <br /> defined by code. IPMC section 108.1.4 <br /> Unsafe conditions were observed within the structure as mentioned. IPMC section 108.1.1 defines this as"Unsafe <br /> Structure" <br /> It is my recommendation that the lower portion of the structure be vacated until corrective measures have been made <br /> (permits required), and approvals to occupy this portion of the building have been granted by this department. <br /> I fully support your enforcement efforts to abate these conditions <br /> Thank you for the opportunity to provide assistance in this matter. <br /> 4,77, Regards <br /> Ted M.de Budden <br /> Chief Inspector <br /> Public Works <br /> (425)257-7271 <br /> 1 <br />
