Hearing Date, Time & Location <br />Respondents are scheduled to appear before the Violations Hearing Examiner on; <br />HEARING DATE: Thursday, October 18, 2012 at 1pm <br />LOCATION: City of Everett Violations Hearing Room <br />Wall Street Building, Suite # 8-C <br />2930 Wetmore Avenue <br />Everett, Wa 98201 <br />6. Agreed Order <br />If the respondent is not a Repeat Violator (see Paragraph 1) and has completed <br />the minimum corrective action described in this citation, he/she is eligible to enter <br />into an agreed order with the city. The agreed order means that the city agrees <br />that it will not take further action against the respondent regarding the violations <br />described in this citation as long as there are no further nuisance -related EMC <br />violations for the two-year period following the date of the order. If the <br />Respondent is eligible to enter into and agreed order with the city and signs <br />the agreed order, the Respondent is no longer required to appear at the hearing <br />set forth in Paragraph 5. <br />7. Hearing Examiner <br />Following the hearing, the Violations Hearing Examiner may issue an order <br />against the Respondent, even if he/she does not attend the hearing. <br />The Hearing Examiner's Order may: <br />A. Require that the violations be corrected by a specific date; <br />B. Impose a monetary penalty in accordance with EMC Chapter 1.20; <br />C. Authorize the City to enter the property, correct the violations and to assess <br />the costs of the corrections as permitted by law <br />A copy of your proposed Hearing Examiner Order, will be available for pick-up at <br />the Police Department Records Unit counter at 3002 Wetmore after 2pm, on the <br />day before your hearing.
