No work has been conducted since work that was completed under a "Permit in April12008-from <br />the City of Everett (Permit B0803-003 in April 2008). We are in possession of a "City of Everett <br />Inspection Record" documenting that the work at the time was inspected and "Approved". <br />2. The building was continuously occupied by a retail tenant (Xtreme Floors Inc.) from July 2008 <br />until the current retail occupant took occupancy in Aug. 2012. At no time from mid 2008 when we <br />had the: City's inspection and approval pursuant to Permit B0803-003 until receiving the subject <br />violation citation was there any notice: from the city regarding any irregularity or any unsatisfactory <br />conditions in the building. There has been no change of use since 2008, ie retail to retail. <br />3. The new tenant has not altered the use of the building, including the second level, which is not <br />used as an area accessible to the public. <br />We as owners are willing to address any legitimate concerns. However, it appears that the City's <br />Public Works staff is acting without knowledge of the facts and has triggered a process that is <br />cumbersome and expensive to the owner, and the City, for that matter, without the facts supporting <br />its action. Again, we as owners are more than willing to work with the City to address any <br />legitimate concerns, but it seems to us that to trigger a police enforcement process under these <br />facts is heavy-handed and is a use: of staff and police resources that is both unnecessary and <br />unwarranted. <br />The use of the building has been substantially donated by us for use by this charitable thrift store. <br />The Always Something Thrift Store is a 501 (c) 3 non-profit entity which donates all net proceeds of <br />the business to two cancer support and cancer research charities respectively.
