(6) The need for the requested variance is not the result of a self- <br /> created hardship. <br /> CONCLUSIONS BASED ON FINDINGS <br /> 1. The Applicant requested approval of a variance from a development standard of <br /> the Everett Municipal Code(EMC) Section 19.07.020.M(3) which prohibits <br /> accessory structures over 1,000 square feet from being located between the <br /> principal building and an adjoining street. The requested variance would allow a <br /> detached 1;496 square foot accessory structure to be located between the <br /> principal residence on the subject property and Highland Road. (finding 1) <br /> 2. The variance will not be materially detrimental to the properties in the area of the <br /> subjeet property or to the City as a whole. (findings 8, 10, 11 and 15) <br /> 3. The variance is necessary because of exceptional and extraordinary <br /> circumstances regarding the topography of the site, as well as the location of a <br /> pre-existing improvement on the subject property. (findings 3, 11, 1.3 and 15) <br /> 4. The variance will grant the owner of the subject property the same general rights <br /> enjoyed by other property owners in the area with similar properties. (finding 13) <br /> 5. The variance is the minimum necessary to allow the property general rights for <br /> development. (finding 13) <br /> 6. The grant of the variance is consistent with the goals and policies of the Everett <br /> Comprehensive Plan. (finding 14) <br /> 7. The requested variance is not the result of a self-created hardship. (finding 15) <br /> DECISION <br /> Based upon the.preceding Findings of Fact and Conclusions and testimony and <br /> evidence submitted at the public hearing, it is hereby ordered that a variance from the <br /> provisions of EMC 19.07.020.M(3) is granted. The Applicant is allowed to have an <br /> accessory structure of approximately 1,496 square feet to be located between the <br /> existing residence and Highland Road. The variance is granted for the property at 238 <br /> Highland Road and is subject to the following conditions; <br /> 1. The design of the indoor swimming lane building, including, but not limited to, the <br /> height, siding and roofing, must remain consistent with the plans as shown in <br /> Exhibits 3 and 4. <br /> 2. A covenant acceptable to the City Attorney's office shall be recorded on the title <br /> of the property stating that the property owner acknowledges the requirements of <br /> 5 <br />
