(6) The need for the requested variance is not the result of a self-
created hardship.
CONCLUSIONS BASED ON FINDINGS
1. The Applicant requested approval of a variance from a development standard of
the Everett Municipal Code(EMC) Section 19.07.020.M(3) which prohibits
accessory structures over 1,000 square feet from being located between the
principal building and an adjoining street. The requested variance would allow a
detached 1;496 square foot accessory structure to be located between the
principal residence on the subject property and Highland Road. (finding 1)
2. The variance will not be materially detrimental to the properties in the area of the
subjeet property or to the City as a whole. (findings 8, 10, 11 and 15)
3. The variance is necessary because of exceptional and extraordinary
circumstances regarding the topography of the site, as well as the location of a
pre-existing improvement on the subject property. (findings 3, 11, 1.3 and 15)
4. The variance will grant the owner of the subject property the same general rights
enjoyed by other property owners in the area with similar properties. (finding 13)
5. The variance is the minimum necessary to allow the property general rights for
development. (finding 13)
6. The grant of the variance is consistent with the goals and policies of the Everett
Comprehensive Plan. (finding 14)
7. The requested variance is not the result of a self-created hardship. (finding 15)
DECISION
Based upon the.preceding Findings of Fact and Conclusions and testimony and
evidence submitted at the public hearing, it is hereby ordered that a variance from the
provisions of EMC 19.07.020.M(3) is granted. The Applicant is allowed to have an
accessory structure of approximately 1,496 square feet to be located between the
existing residence and Highland Road. The variance is granted for the property at 238
Highland Road and is subject to the following conditions;
1. The design of the indoor swimming lane building, including, but not limited to, the
height, siding and roofing, must remain consistent with the plans as shown in
Exhibits 3 and 4.
2. A covenant acceptable to the City Attorney's office shall be recorded on the title
of the property stating that the property owner acknowledges the requirements of
5
