ORDINANCE NO. 707-80 AN ORDINANCE providing for the improvement of the alley West of Wetmore Avenue from Pacific Avenue North to the East-West alley South of Hewitt Avenue by the conversion of overhead electrical and communication facilities to underground, and includes all incidental material appurtenances and work necessary for a complete improvement thereto. WHEREAS, the City Council has declared its intention to order the improvement as outlined hereafter and doing all work in connection therewith to make a complete improvement in accordance with the plans and specifications of the City Engineer of the City of Everett; and WHEREAS, RCW 35.96.060 has found and declared that the conversion of overhead electric and communication facilities to underground is substantially beneficial to the public safety and welfare, is in the public interest and is a public purpose; and WHEREAS, the City Council held a hearing on May 11, 1980, after due public notice and thereafter directed that an Ordinance be presented; NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: That the City Council of the City of Everett finds and declares that the improvement hereinafter described is in the public interest and hereby directs its construction. Section 2: That an improvement be made of: The alley West of Wetmore from Pacific Avenue, North to the East-West alley South of Hewitt Avenue by the conversion of overhead electrical and communication facilities to underground, and includes all incidental material appurtenances and work necessary for a complete improvement thereto. All of the aforesaid improvements shall be in accordance with plans to be prepared by the City Engineer, which plans and specifications are hereby adopted and approved. -1-
