ORDINANCE NO. 90 go AN ORDINANCE providing for the vacation of a portion of Oakes Avenue lying North of vacated 38th Street. WHEREAS, the City Council of the City of Everett did by Resolution No. 1793 duly adopted and fix the 28th day of May, 1980, at 8:30 a.m., for the public hearing; and WHEREAS, due and legal notice of the time and place of said hearings and determination of said Resolutions has been given by the City Clerk in the manner prescribed by law; and WHEREAS, at the time and place fixed for favorable statements and objections to the vacating of the herein described street were heard and discussed; and WHEREAS, City Council finds, as a result of said public hearing, that the street vacation provides a public benefit and that the public interest is served thereby; and WHEREAS, it now appears to the City Council of the City of Everett that the portion of said resolved to be vacated should be vacated; NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: That portion of Oakes Avenue described as follows: Beginning at the Southeast corner of Block 923, Plat of Everett Division "M", recorded in Volume 5 of Platsd page 8, records of Snohomish County, Washington; thence N 0 002" W along the East line of said Block 65.00 feet; thence N 55 37'32" E 96.81 feet to $point on the West line of Block 924 of said plat; thence S 0 00'32" E along said West line 119.8 feet to the Southwest corner of said Block 924; thence N 89 58'52" W 79.91 feet to the point of beginning. be and the same is hereby vacated pursuant to the following conditions: Section 2: The City of Everett, its successors or assigns shall not be responsible or liable for storm drainage runoff resulting from existing drainage patterns as established on City rights-of-way that may now or in the future go over, under, or across the above described street vacation. -1-
