D <br /> ORDINANCE NO. /2r--.fVJ <br /> AN ORDINANCE providing for the vacation of the <br /> alleys in Block 750 of Everett Land Company's 1st <br /> Addition to Everett and the alley in Block 753 of said plat <br /> lying North of the North line of the South 24 feet projected <br /> Easterly of Lot 11 in said block and 32nd Street East of Pine <br /> Street between Block 750 and Block 753 in said plat. <br /> WHEREAS, the City Council of the City of Everett did by Resolution <br /> No. 1258 duly adopted and fix the 13th day of April, 1977, at 10:00 a.m., as <br /> the date for public hearing; and <br /> WHEREAS, due and legal notice of the time and place of said hearing and <br /> determination of said Resolution has been given by the City Clerk in the manner <br /> prescribed by law; and <br /> WHEREAS, at the time and place fixed for hearing favorable statements and <br /> objections to the vacating of the herein described street and alleys were heard and <br /> discussed; and <br /> WHEREAS, City Council finds, as a result of said public hearing, that the <br /> street and alley vacation provides a public benefit and that the public interest is <br /> served thereby; and <br /> WHEREAS, it now appears to the City Council of the City of Everett that the <br /> portion of said streets and alley resolved to be vacated should be vacated; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: <br /> The alleys in Block 750 of Everett Land Company's 1st Addition to Everett and <br /> the alley in Block 753 of said plat lying North of the North line of the South 24 feet <br /> projected Easterly of Lot 11 in said block, and 32nd Street East of Pine Street <br /> between Block 750 and Block 753 in said plat and West of Interstate No. 5 <br /> be and the same is hereby vacated pursuant to the following conditions: <br /> Section 2: <br /> The City of Everett, its successors or assigns shall not be responsible or liable <br /> for storm drainage runoff resulting from existing drainage patterns as established on <br /> City rights-of-way that may now or in the future go over, under, or across the above <br /> described street and alley vacation. <br /> Section 3: <br /> The petitioner shall dedicate to the City of Everett a 24 foot alleyway across <br /> the South 24 feet of Lot 11, Block 753, plat of Everett, according to the plat thereof <br /> recorded in Volume 3 of Plats, page 20, records of Snohomish County, Washington. <br /> Section 4: <br /> That this ordinance shall not become effective until the owners of the property <br /> abutting upon the street herein described shall compensate the City of Everett <br /> amount equal to one-ha;f the 1977 appraised value ($85,000) of the area herein describe., <br /> Less area dedicated to the City of Everett as recited in Section 3 of this ordinance. <br /> Provided, however, should the abutting property owners fail to exercise this vacation <br /> within 90 days following passage, unless otherwise extended by City Council, the <br /> ordinance shall be null and void. <br /> -1- <br />
