(; <br /> 2 <br /> AN ORDINANCE authorizing the condemnation of right-of-way, if <br /> 3 necessary, for 77th Street, east of and connecting to Evergreen Way. <br /> 4 <br /> 5 <br /> WHEREAS, the City Council of the City of Everett finds as follows: <br /> 6 <br /> 1. A traffic study has been completed which demonstrates the need of a <br /> 7 <br /> traffic corridor from Casino Road to Evergreen Way connecting at 77th Street. <br /> 8 <br /> 2. Ordinance No. 640-79 and 679-80 required the Everett School District to <br /> 9 <br /> provide a sixty (60) foot wide right-of-way along its easterly property line at Cascade <br /> 10 <br /> High School which provides a portion of the right-of-way necessary for the traffic <br /> 11 <br /> corridor from Casino Road to Evergreen Way at 77th Street. The School District has <br /> 12 <br /> conveyed the required portion of right-of-way by Warranty Deed recorded under <br /> 13 <br /> Snohomish County Auditor's File No. 8005020264. <br /> 14 <br /> 3. Development in the area of the proposed traffic corridor including the <br /> 15 <br /> new shopping center at 75th Street and Evergreen Way has placed additional demands on <br /> 16 <br /> the existing streets, particularly 75th Street, Casino Road and Evergreen Way thereby <br /> 17 <br /> intensifying the need for an additional east-west traffic corridor at 77th Street. <br /> 18 <br /> 4. The traffic corridor at 77th Street would mitigate the traffic circulation, <br /> 19 <br /> safety and efficiency impacts of recent development in the area as well as aid future <br /> 20 <br /> development by promoting more orderly traffic flows and access onto, off of and across <br /> 21 <br /> Evergreen Way. <br /> 22 <br /> 5. The right-of-way acquired for the 77th Street traffic corridor would be <br /> 23 <br /> utilized for a public street and appurtenant improvements. <br /> 24 <br /> 6. The property sought to be acquired for the traffic corridor at 77th Street <br /> 25 <br /> is shown in Exhibit "A" attached hereto and incorporated by reference herein. <br /> 26 <br /> 7. The public interests of the City of Everett require that the property <br /> 27 <br /> shown in Exhibit "A" be acquired for permanent public use as a public right-of-way for <br /> 28 the citizens of Everett. <br /> 29 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> 30 Section 1: That the City Council of the City of Everett does hereby authorize <br /> 31 the Engineering Department to acquire, if necessary, by condemnation, in accordance <br /> 32 <br />
