1 ORDINANCE NO. a. fy—Pc) <br /> 2 <br /> AN ORDINANCE authorizing the condemnation of City of Everett sewage <br /> 3 treatment Lagoon property on Smith Island. <br /> 4 <br /> 5 WHEREAS, the City Council of the City of Everett finds as follows: <br /> 6 1. All sanitary sewage collected in the City of Everett and adjacent areas is <br /> 7 transmitted to Smith Island for treatment and disposal in sewage treatment lagoons, <br /> 8 some of which are constructed on property owned by the City of Everett and some of <br /> 9 which are constructed on property owned by the State of Washington and administrated <br /> 10 by the Department of Natural Resources (DNR) and rented to the City of Everett. (Said <br /> 11 DNR property is legally described in Exhibit A attached hereto and incorporated herein <br /> 12 by reference.) <br /> 13 2. The presently constructed sewage treatment lagoons on the said DNR- <br /> 14 administrated property described in Exhibit A are a necessary part of the City of <br /> 15 Everett sewer system, serving all members of the public who live and work in the City <br /> 16 of Everett and adjacent areas; further, Exhibit A includes additional property adjacent <br /> 17 to presently constructed sewage treatment lagoons which property is necessary for <br /> 18 future expansion of the Everett sewage treatment system. <br /> 19 3. Said sewage treatment lagoons described in Exhibit A have never been <br /> 20 used for any other public use than as part of the City of Everett sewage disposal <br /> 21 system. <br /> 22 4. The public interests of the City of Everett require that the property <br /> 23 described in Exhibit A be acquired for permanent public use as present and future <br /> 24 sewage treatment lagoons and other sewer system facilities for the citizens of the City <br /> 25 of Everett and adjacent areas. <br /> 26 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> 27 Section 1: It is hereby determined that the City of Everett, with funds <br /> 28 provided through the Sewer Department, shall acquire, by condemnation, if necessary, <br /> 29 the DNR-administrated property referred to in Finding No. 1 above and legally <br /> 30 described in Exhibit A attached hereto and incorporated herein by reference. <br /> 31 <br /> 32 <br />
