ORDINANCE NO. 9',1/ An Ordinance creating the office of Land Use Hearing Examiner to provide a land use regulatory hearing system. WHEREAS, it is in the best interest of the City of Everett and its citizens to provide a land use regulatory hearing system to expeditiously and fairly implement the land use regulations, NOW, THEREFORE, the City of Everett does ordain: Section 1: This Ordinance hereinafter be known as the "Land Use Hearing Examiner Ordinance", or "Hearing Examiner Ordinance", may be cited as such, will hereinafter be referred to as "this Ordinance" and same shall be and constitute Chapter , Title (Building Regulations) of Ordinance Number , known as the "Code of General Ordinances of the City of Everett". Section 2: PURPOSE: The purpose of this ordinance is to provide an administrative land use regulatory system which will best satisfy the following needs: A. Provide a single, efficient, integrated land use regulatory hearing system. B. Render land use regulatory decisions and recommendations to the City Council. C. Provide a greater degree of fairness and due process in land use regulatory hearings. D. Separate the City's land use planning program from the land use regulatory process. E. Protect the community's general health, safety and welfare as provided for in RCW 35.63. Section 3: CREATION OF LAND USE HEARING EXAMINER: The office of the Land Use Hearing Examiner, hereinafter referred to as Examiner, is hereby created. The Examiner shall interpret, analyze, review, and implement land use regulations as provided in this Ordinance and other ordinances. Provided also that the Examiner does not have the power to create new ordinances. The term Examiner shall likewise include the Examiner Pro Tem. It is further provided that to the maximum extent feasible, the Office of the Hearing Examiner shall be financially self supporting through reliance upon application and related user fees.
