v . . <br /> Section 23: DELEGATION OF HEARING EXAMINER'S AUTHORITY: In the Event <br /> of both the Examiner's and the Examiner Pro Tern's disqualification, incapacity, or <br /> inability to timely process the volumes of applications submitted, the <br /> Environmental Review Committee may assume the duties and responsibilities of <br /> the Examiner in regard to applications listed in Section 12.A.1(b). The Planning <br /> Commission may assume and carry the duties and responsibilities of the Examiner <br /> for all applications other than those listed in Section 12.A.1(b) in the manner <br /> prescribed by the Chapter; PROVIDED, <br /> that, if, after considering the matter at a public meeting, the City Council deems <br /> that a change in the Environmental Review Committee's or Planning Commission's <br /> recommendation on any application is necessary, such change shall not be made <br /> until the Council has conducted its own public hearing, giving notice thereof as <br /> required by law. The Examiner may promulgate rules governing such transfer of <br /> application. <br /> Section 24: SEVERABILITY: The provisions of this Ordinance are hereby declared <br /> to be severable. If any word, phrase, clause, sentence, paragraph, section, or part <br /> in or of this Ordinance, or the application thereof to any person or circumstance, is <br /> declared invalid, the remaining provisions and the application of such provisions to <br /> other persons or circumstances shall not be affected thereby, but shall remain in <br /> full force and effect, the Mayor and City Council hereby declaring that they would <br /> have ordained the remaining provisions of this Ordinance without the word, phrase, <br /> clause, sentence, paragraph, section, or part, or the application thereof, so held <br /> invalid. <br /> -10- <br />
