1 effect until August 31, 1981, unless extended by the Everett City Council or earlier <br /> 2 terminated. The Mayor is authorized to inform appropriate State, County and special <br /> 3 service district officials and to take all steps necessary, including legal action, to <br /> 4 enforce this moratorium on the granting of building permits inside and outside the City, <br /> 5 if the granting of such permit will result in increased flows to Lift Station No. 24 in the <br /> 6 area shown on the map attached hereto and incorporated herein by reference. Upon the <br /> 7 applicant's compliance with all other applicable laws, ordinances and regulations, the <br /> 8 appropriate Building Official shall be authorized to issue building permits in the event <br /> 9 of the agreement of the applicant that the structure shall not be occupied and the side <br /> 10 sewer connected to the public sewer prior to August 31, 1981, or such earlier or later <br /> 11 date that the City Council may designate. <br /> 12 Section 2: That the moratorium imposed by this ordinance will not apply to <br /> 13 the following categories; provided, however, the Mayor may suspend any or all of the <br /> 14 following catagorical exemptions in the event of•an actual overflow of sewage effluent <br /> 15 from Lift Station No. 24 or from a,manhole in the line flowing into said Lift Station: <br /> 16 <br /> A. Single family lots and single family lots in plats with <br /> 17 preliminary approval to which there presently exists an available side <br /> sewer connection. <br /> 18 <br /> B. Property which can be served by an approved septic tank <br /> 19 system or other sewage treatment system which does not discharge into <br /> the City of Everett sewer system. "Approved system" means any system <br /> 20 approved by the Snohomish Health District. <br /> 21 C. Additions or remodeling of existing dwelling units or <br /> commercial structures already connected to the City of Everett sewer <br /> 22 system the effect of which will not increase the total number of dwelling <br /> units or the present sewage being discharged into the sanitary sewer <br /> 23 system. <br /> 24 D. Buildings for which completed applications for building <br /> permit or sewer connection permits were filed with the City of Everett, <br /> 25 Snohomish County or special service districts contracting with the City <br /> prior to the close of business on the date this ordinance becomes valid. <br /> 26 <br /> E. Improved property on which a serious health hazard, as <br /> 27 found by the Mayor of Everett or the Director of the Snohomish Health <br /> District, requires connection to the public sewer system. <br /> 28 <br /> 29 Section 3: That the Mayor is directed to proceed with design and construction <br /> 30 of facilities to increase the capacity of Lift Station No. 24 to accommodate anticipated <br /> 31 growth inside and outside the City of Everett which is dependent on the said facility. <br /> 32 -2- <br />
