C77-S0 <br /> AN ORDINANCE creating a special construction fund <br /> entitled "Regional Detention Facilities Construction <br /> Fund No. 340." <br /> WHEREAS, the City Council recognizes a need for regional detention <br /> facilities in lieu of on-site detention; and <br /> WHEREAS, the City Council recognizes that Regional Facilities <br /> are cost effective for private developers and in the best interest <br /> of the City; and <br /> WHEREAS, the City Council is requiring private developers to <br /> participate in the cost of constructing these regional detention <br /> facilities; <br /> NOW, THEREFORE, BE IT ORDAINED by the Everett City Council <br /> that: <br /> Section 1: A special construction fund is hereby established <br /> as Fund No. 340 entitled "Regional Detention Facilities Construction <br /> Fund" to accomplish the actions authorized in the subsequent sections <br /> of this ordinance. <br /> Section 2: Authorization is hereby granted to the Public Works <br /> Director to construct Regional Detention Facilities. These facilities <br /> shall be designated with program numbers 771 thru 780. Funds will be <br /> appropriated from Fund 340 as needed to construct these facilities. <br /> The City shall acquire all materials, equipment, personal and <br /> real property interest therein, easements, franchises, and rights- <br /> of-way necessary to carry out the above described plans. <br /> The order of construction of the above improvements shall be as <br /> determined by the Public Works Director of the City of Everett. <br /> Section 3: The Public Works Director of the City of Everett <br /> under the administration of the Mayor is hereby given responsibility <br /> for conducting all tasks outlined under Section 2. <br /> Section 4 : The City Treasurer of the City of Everett shall <br /> collect funds from private developers in the area to be serviced <br /> by the specific Regional Detention Facilities. These funds shall <br /> be invested by the City Treasurer of the City of Everett consistent <br /> with arbitrage regulations. The interest earned shall be deposited <br /> in the fund and expended for this project.
