1 ORDINANCE NO. b!l -Xao <br /> 2 <br /> AN ORDINANCE amending Ordinance No. 556-78 and providing an <br /> 3 alternate method of calculating cash deposits or payment guarantees <br /> for interim improvements to Casino Road. <br /> 4 <br /> 5 <br /> 6 WHEREAS, the City Council has adopted Ordinance No. .556-78 which provided <br /> 7 an orderly method of addressing the adverse environmental impact of traffic congestion <br /> 8 on Casino Road generated by the accelerated level of new development in the areas <br /> 9 impacting Casino Road; and <br /> 20 WHEREAS, Section 2 (B) of Ordinance No. 556-78 established a method of <br /> 11 accumulating cash deposits and payment guarantees for the funding of interim <br /> 12 improvements to Casino Road to allow development in the areas impacting Casino Road <br /> 13 to continue while at the same time creating procedure for mitigation of traffic impacts <br /> 14 generated by such development; and <br /> 15 WHEREAS, it has been determined by analysis of various types of development <br /> 16 that certain uses impact vehicular trips on Casino Road to lessor degree than others; <br /> 17 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> 18 Section 1: Section 2 (B) of Ordinance No. 556-78 which reads as follows: <br /> 19 <br /> B. Interim Improvements: Each property owner proposing new <br /> 20 development or improvement within the benefit area (Exhibit 1) <br /> shall, prior to issuance of a Building Permit, financially contribute <br /> 21 to the interim improvement of Casino Road between Airport Road <br /> and Evergreen Way according to and in the following manner: <br /> 22 <br /> 1. If the development or improvement abuts upon or has <br /> 23 primary access from Casino Road between Airport Road and <br /> Evergreen Way, the developer shall: <br /> 24 <br /> a. Pay to the City, a non-refundable cash deposit in the <br /> 25 amount of: <br /> 26 (1) $583 per unit of a multiple family residential <br /> development. <br /> 27 <br /> (2) $900 per single family residential unit, or, <br /> 28 <br /> (3) $90 per average daily trip for business, <br /> 29 commercial and special use development; or an <br /> amount which shall be determined by <br /> 30 multiplying the total number of units possible <br /> (based on R-3 zoning) by $583. Cash deposit <br /> 31 amount shall be determined by whichever <br /> method is greater; or <br /> 32 <br />
