Payment guarantee amount shall be <br /> determined by whichever method is greater. <br /> 4 <br /> c. Provided, however, at the option of the applicant, <br /> 5 business, commercial and special use development <br /> may elect to provide the City with a recordable <br /> 6 covenant (acceptable to the City Attorney) with an <br /> attached Exhibit on 8Y2" x 14" scaled diagram <br /> 7 (acceptable to the City Engineer) detailing the <br /> proposed development designating the occupancy <br /> 8 use(s) of the development and covenanting the real <br /> property to those specific uses until the Ultimate <br /> 9 Street Improvement has been constructed. If such a <br /> covenant is provided, business, commercial and <br /> 10 special use development cash deposits or payment <br /> guarantees as outlined in paragraphs Section 2: B <br /> 11 1.a.(3) and Section 2: B 1.b.(3) above shall be <br /> determined as follows: <br /> 12 <br /> An amount shall be determined by multiplying the <br /> 13 total number of units possible (based on R-3 zoning) <br /> by Multiple-family rate, and <br /> 14 <br /> An amount shall be determined by multiplying the <br /> 15 average daily trip rate described in subsections <br /> 2(B)(1)(a)(3) or 2(B)(1)(b)(3) by the average daily trips <br /> 16 applicable to the covenanted use, <br /> 17 These amounts shall be compared and in no case shall <br /> the cost to the applicant exceed 120% of the Average <br /> 18 Daily Trip Amount. <br /> 19 d. In the event that real property encumbered by a <br /> covenant committing that property to a specific site <br /> 20 plan and occupancy uses pursuant to subsection <br /> 2(b)(1)(c) above is proposed to be expanded, <br /> 21 redeveloped and/or changed in use, the cash deposit <br /> or payment guarantee for interim improvements to <br /> 22 Casino Road shall be recalculated pursuant to <br /> Ordinance No. .556-78 and any amendments thereto, <br /> 23 including this ordinance, to take into consideration <br /> the expansion, redevelopment and/or change in use <br /> 24 and the vehicular impacts created by such alteration. <br /> The Owner and/or Developer shall provide the <br /> 25 additional cash deposit or payment guarantee prior to <br /> making the expansion, redevelopment and/or change <br /> 26 in use and, where appropriate, shall provide an <br /> amended covenant reflecting the specific uses and <br /> 27 occupancies therefor. <br /> 28 e. On or after January 1, 1981, the City Council may <br /> adjust these charges to meet increased construction <br /> 29 costs. <br /> 30 2. If the development or improvement does not abut or have <br /> primary access from Casino Road between Airport Road and <br /> 31 Evergreen Way but contributes significant traffic to Casino <br /> Road, the Developer shall pay a non-refundable cash deposit <br /> 32 of $90 per Casino Road average daily vehicle trip or provide <br /> the City with a payment guarantee in the sum of $104 per <br /> Casino Road average daily vehicle trip. <br /> -3- <br />
