• 2. Any person or persons violating this chapter or rule or regulation <br /> • adopted hereunder, or by any act of commission or omission, procures, <br /> aids, or abets such violation, shall be guilty of a misdemeanor and upon <br /> conviction, shall be punished by a fine not to exceed Five Hundred Dollars <br /> ($500) and/or imprisonment for a term not to exceed ninety (90) days. <br /> Each day such violation continues shall be considered an additional mis- <br /> demeanor offense. <br /> 3. Any conditions which constitute or will constitute a violation <br /> of any of the provisions of this chapter or rules or regulations adopted <br /> hereunder shall constitute a nuisance for which the City may seek legal <br /> or equitable relief to enjoin any acts or practices or abate any said <br /> conditions. In the event the property owner shall fail to make <br /> corrections, within 15 days of the date of notice by the City, the City <br /> may revoke the right to occupancy of the subject property, may charge <br /> the property owner with a misdemeanor punishable by fines, and may enter <br /> on to the subject property and take such corrective action as may be required <br /> to make the drainage facilities perform as required by the approved drainage <br /> plan. All costs for corrective measures and enforcement actions shall <br /> be borne by the property owner. <br /> 4. Notwithstanding, any other provision of this ordinance, whenever <br /> the City Engineer finds that a violation of this chapter or rules or <br /> regulations adopted hereunder has created or is creating an unsanitary, <br /> dangerous, or other condition which, in his judgment, constitutes an <br /> immediate hazard, he may suspend or revoke any permit for which the ap- <br /> proval of a drainage plan is required on the project or development where <br /> the violation exists and suspend or terminate operations under the permit <br /> immediately. <br /> Any person causing material to be discharged to or enter the <br /> drainage system of the City shall be liable for all costs incurred by <br /> the City or others in cleaning up or correcting said action and may be <br /> charged with a misdemeanor punishable by fines. <br /> 5. Penalty or enforcement provisions provided herein shall not <br /> be exclusive, and the City may pursue any remedy or relief deemed appropriate <br /> in a response to a violation of this new chapter to the Everett Municipal <br /> Code or the rules and regulations adopted hereunder. <br /> The City Council may institute a suit for a mandatory injunction <br /> directing a person to remove a structure or make the same comply with <br /> its terms. If the City Council is successful in its suit, the respondent <br /> shall bear the costs of the action, including reasonable attorney fees. <br /> The failure or refusal of the City to enforce any provision of this <br /> ordinance, and as hereafter amended, shall not constitute a waiver or <br /> bar to prevent enforcement thereof against any person for a subsequent <br /> violation hereof, or for any other violation by any other person. <br /> A new Section Number 17 shall be added with the title, Fees, to be <br /> worded as follows: <br /> Section 17: Fees <br /> 1. The following fe9 schedule shall apply whereas detailed drainage <br /> plan is required, which schedule is in addition to other applicable fees. <br /> Where a drainage plan involves several of the permits or approvals listed <br /> below, the highest single fee shall apply. <br /> -4- <br />
