• <br /> ORDINANCE NO. ‘ 61:4( (� <br /> An Ordinance amending the Zoning Map of the <br /> City of Everett, as provided by Everett <br /> Municipal Code, Title 19 (Ordinance 3572) <br /> WHEREAS, on December 18, 1979, the Planning Commission held a public <br /> hearing regarding rezoning the hereinafter described property from R-1 <br /> Single Family Low-Density Residential and C-1, General Commercial zones <br /> to R-1, Single-Family Low-Density Planned Residential Development, and <br /> WHEREAS, the City Council of Everett, after hearing the recommendations <br /> of the Planning Commission of the City of Everett, has determined that said <br /> property should be rezoned and zoned R-1, Single-Family Low-Density Planned <br /> residential Development (per Ordinance 414-76, Section 7D) <br /> NOW, THEREFORE, the City of Everett does ordain: <br /> Section 1: That the City Council of the City of Everett <br /> does hereby find that the PRD zoning change hereinafter <br /> set forth is in the best interest of the City of Everett <br /> and meets the purpose and requirements of the Planned <br /> Residential Development Ordinance No. 414-76. <br /> Section 2: That the proposed zoning is based on the applicant <br /> meeting the conditions stated in the attached development con- <br /> tract, and developing the rezoned area per the project site plan. <br /> Section 3: That the Zoning Map of the City of Everett as <br /> established by Everett Municipal Code Title 19 (Ordinance 3572, <br /> Section 4, as amended) is hereby amended as follows: <br /> Lots 1, 2, 3, 4, 5, 10, 11 and a portion of Lot 9 of the Plat of Intercity <br /> Addition No. 1, as per plat recorded in Volume 11 of Plats on page 9, <br /> records of Snohomish County, Washington, more particularly described as <br /> follows: <br /> Beginning at the Southwest corner of said Lot 9; thence North 310 East a <br /> distance of 236.52 feet to the Northwest corner of said Lot 9; thence <br /> North 89024' East a distance of 154.67 feet along the North line of said <br /> Lot 9; thence South 0036' East parallel with the East line of said Lot 9 a <br /> distance of 200 feet to the South line of said Lot 9; thence South 89024' <br /> West along the South line of said Lot 9 a distance of 280.94 feet to the <br /> Southwest corner of Lot 9 and the POINT OF BEGINNING. <br /> EXCEPT that portion of Lots 1, 2, 3, 4, 5, and 9 lying Southwesterly of a <br /> line which is parallel with and lies 90 feet Southwesterly as measured <br /> perpendicular to the Northeasterly line of said lots 1, 2, 3, 4, and 5. <br /> ALSO EXCEPT the East 160 feet of Lot 11 and the East 160 feet of the South <br /> 10 feet of Lot 10 of said Plat of Intercity Division No. 1. <br /> Section 4: This parcel, now zoned R-1 Single Family Low-Density <br /> Residential, is hereby rezoned and is now zoned R-1, Single-Family Low- <br /> Density Planned Residential Development. <br /> Section 5: Failure to meet the conditions of the attached contract <br /> shall result in reconsideration of this rezone action by the Planning Com- <br /> mission and City Council, and future development of said parcel shall then <br /> be subject to requirements of R-1, Single-Family Low-Density Residential <br /> Zoning per Ordinance 414-76, Section 7H. <br /> Section 6: The City Clerk is hereby instructed to file the fully <br /> certified copy of this Ordinance with the County Auditor of Snohomish <br /> County, Washington. <br />
