Y . , <br /> • <br /> Ordinance No. (c — 7O <br /> An Ordinance amending the Zoning Map of the <br /> City of Everett, as provided by Everett <br /> Municipal Code, Title 19 (Ordinance 3572) <br /> (Creekside Condominium PRD) <br /> WHEREAS, on October 24, 1979, the Planning Commission held a <br /> public hearing regarding rezoning the hereinafter described property <br /> from R-2, Single-Family High-Density Residential to R-2, Single-Family <br /> High-Density Planned Residential Development, and <br /> WHEREAS, the City Council of Everett, after hearing the recommendations <br /> of the Planning Commission of the City of Everett, has determined that said <br /> property should be rezoned and zoned R-2 Single-Family High-Density Planned <br /> Residential Development (per Ordinance 414-76, Section 7D) <br /> NOW, THEREFORE, the City of Everett does ordain: <br /> Section I : That the City Council of the City of Everett does <br /> hereby find that the PRD zoning change hereinafter set forth <br /> is in the best interest of the City of Everett and meets the <br /> purpose and requirements of the Planned Residential Development <br /> Ordinance No. 414-76. <br /> Section 2: That the proposed zoning is based on the applicant <br /> meeting the conditions stated in the attached development contract, <br /> and developing the rezoned area per the project site plan. <br /> Section 3: That the Zoning Map of the City of Everett as established <br /> by Everett Municipal Code Title 19 (Ordinance 3572, Section 4, as <br /> amended) is hereby amended as follows: <br /> Parcel A: <br /> All that portion of Lots 47 through 51 inclusive, Plat of Fairview <br /> Heights, according to the Plat thereof, recorded in Volume II of <br /> Plats, page 56, records of the Auditor of the County of Snohomish, <br /> State of Washington and Lot 22 of Fairview Heights Division, No. 2, <br /> according to the plat thereof, recorded in Volume II of Plats, page <br /> 68, records of the Auditor of the County of Snohomish, State of <br /> Washington, described as follows: <br /> Commencing at the Southwest corner of Lot 50 of said Plat; thence <br /> South 88° 23' 27" East along the South line of said Lot, for <br /> 180 feet, thence North 2° 01 ' 23" East for 122.74 feet; thence <br /> South 89° 01 ' 27" East for 235.54 feet to the East line of said <br /> Lot 51 and true point of beginning; thence North 89° 01 ' 27" West <br /> for 235.54 feet; thence North 2° 01 ' 33" East for 166.56 feet to <br /> the Northwesterly line of Lot 50; thence North 46° 47' 33" East <br /> along the Northwesterly line of Lot 50 to a point 326.21 feet <br /> Southwesterly from the most Northerly corner of said Lot 50; <br /> thence North 86° 07' West 100 feet to the Southeast corner of <br /> that certain tract previously conveyed to John C.
