l ` ORDINANCE NO. to /✓ 4 AN ORDINANCE providing for the improvement of: Hardeson Road, from Casino Road to the South City Limits. Improvements will consist of street widening and the installation of curbs, gutters, sidewalks, water main, sanitary sewer, storm drainage, and all necessary ap- purtenances to provide for a complete improvement; creating a Local Improvement District Fund therefore and providing for the payment of said improvement by special assessments on the property in said District under the mode of payment by bonds or installment notes. WHEREAS, the City Council has declared its intention to order the improvement as outlined hereafter and doing all work in connection therewith to make a complete improvement in accordance with the plans and specifications of the City Engineer of the City of Everett; and WHEREAS, the City Council held a hearing on September 19, 1979, after due public notice and thereafter directed that an Ordinance be presented; NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: That the City Council of the City of Everett finds and declares that the improvement hereinafter described is in the public interest and hereby directs its construction. Section 2: An Ordinance providing for the improvement of Hardeson Road, from Casino Road to the South City Limits. Improvements will consist of street widening and the installation of curbs, gutters, sidewalks, water main, sanitary sewer, storm drainage, and all necessary appurtenances to provide for a complete improvement. All of the aforesaid improvements shall be in accordance with plans to be prepared by the City Engineer, which plans and specifications are hereby adopted and approved. Section 3: That the cost and expenses of the improvement, including but not limited to, all necessary and incidental expenses or fees or property acquisition costs, shall be borne by and assessed against the property included in the assessment district herein created. The costs and the expenses of the improvement to be assessed against the property, including the assessment district herein created, shall be assessed in accordance with the special benefits derived from the improvement and without regard to the zone and termini method of spreading assessments. The City shall not be liable in any manner for any of the remaining expense and costs of the improvement except as provided in Chapter 144, Session Laws of 1923 or acts amendatory thereto, and the ordinances of the City of Everett. Section 4: That there is hereby established a LOCAL IMPROVMENT DISTRICT TO BE KNOWN AS "LOCAL IMPROVEMENT DISTRICT NO. 703" WHICH DISTRICT SHALL INCLUDE THE FOLLOWING described property located in Everett, Snohomish County, Washington: All that portion of the East 845 feet of the Northeast Quarter of the Northwest Quarter of Section 13, Township 28 North, Range 4 East, W.M. f
