- 1 ORDINANCE NO.6, ? - 77 2 AN ORDINANCE authorizing the condemnation of the right-of-way, if 3 necessary, on 19th Avenue from SR 5 to 112th Street. 4 5 WHEREAS, on September 28, 1977, the City did submit to the State of 6 Washington Urban Arterial Board (UAB) a project prospectus for funding the design, 7 preparation of plans, specifications, cost estimate, right-of-way acquisition, and 8 construction of the 19th Avenue street widening project from SR 5 to 112th Street; and 9 WHEREAS, the UAB did approve the project in the amount of $1,460,000 (UAB 10 $1,314,000/City $146,000) as requested in the City's project prospectus on the condition 11 that the project be under contract for construction within 18 months from the date of 12 authorization, January 19, 1978; and 13 WHEREAS, on February 15, 1978, after the required three readings, the City 14 Council did approve the Plans and Systems Ordinance for the 19th Avenue S.E. (SR 5 to 15 112th Street) street widening; and 16 WHEREAS, on February 15, 1978, the City Council did approve the Project 17 Agreement for Preliminary Engineering Proposal between the UAB and the City of 18 Everett and authorized the Mayor to sign the agreement forms; and 19 WHEREAS, on March 22, 1978, the City Council did approve the Consultant 20 Agreement for Preliminary Engineering between Entranco Engineers and the City of 21 Everett for a maximum amount of $142,290; and 22 WHEREAS, Entranco Engineers will have substantially completed the Preliminary 23 Engineering phase of the project by the next meeting of the UAB on February 21, 1979; 24 and 25 WHEREAS, UAB funding for right-of-way acquisition and construction can only 26 be obtained by submittal of a Construction Prospectus to the UAB, including a 27 Resolution by the City Council authorizing condemnation of right-of-way, if necessary, 28 in order to have the project ready for construction within the originally agreed upon 18 29 month time period. 30 31 32
