ORDINANCE NO. 2 `5 �7 <br /> AN ORDINANCE providing for the vacation of a Westerly <br /> portion of Dogwood Avenue, South of Mukilteo Boulevard/ <br /> Wood Place. <br /> WHEREAS, the City Council of the City of Everett did by Resolution <br /> No. 1642 duly adopted and fix the 27th day of June, 1979, at 10:00 a.m., <br /> as the date for public hearing; and <br /> WHEREAS, due and legal notice of the time and place of said hearing <br /> and determination of said Resolution has been given by the City Clerk <br /> in the manner prescribed by law; and <br /> WHEREAS, at the time and place fixed for hearing favorable statements <br /> and objections to the vacating of the herein described street were heard <br /> and discussed; and <br /> WHEREAS, it now appears to the City Council of the City of Everett <br /> that the portion of said street resolved to be vacated should be vacated; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: <br /> That portion of lot 86, Forest Park Addition, Division "A", according <br /> to the plat thereof recorded in Volume 10 of Plats, page 85, records <br /> of Snohomish County, conveyed to the City of Everett for street <br /> purposes on May 6, 1966 and recorded under a. f. #1867992, lying <br /> South and West of the following described line: <br /> Beginning at the Northwest corner of the above described portion <br /> of said lot 86 conveyed to the City of Everett; thence Southeasterly <br /> to a point on the East line of said lot 86 that is 18 feet North of <br /> the Southwest corner thereof and the terminus of this description. <br /> be and the same is hereby vacated pursuant to the following conditions <br /> Section 2: <br /> The City of Everett, its successors or assigns shall not be responsible <br /> or liable for storm drainage runoff resulting from existing drainage <br /> patterns as established on City rights-of-way that may now or in <br /> the future go over, under, or across the above described street <br /> vacation. <br />
