ORDINANCE NO. 2 `5 �7 AN ORDINANCE providing for the vacation of a Westerly portion of Dogwood Avenue, South of Mukilteo Boulevard/ Wood Place. WHEREAS, the City Council of the City of Everett did by Resolution No. 1642 duly adopted and fix the 27th day of June, 1979, at 10:00 a.m., as the date for public hearing; and WHEREAS, due and legal notice of the time and place of said hearing and determination of said Resolution has been given by the City Clerk in the manner prescribed by law; and WHEREAS, at the time and place fixed for hearing favorable statements and objections to the vacating of the herein described street were heard and discussed; and WHEREAS, it now appears to the City Council of the City of Everett that the portion of said street resolved to be vacated should be vacated; NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: That portion of lot 86, Forest Park Addition, Division "A", according to the plat thereof recorded in Volume 10 of Plats, page 85, records of Snohomish County, conveyed to the City of Everett for street purposes on May 6, 1966 and recorded under a. f. #1867992, lying South and West of the following described line: Beginning at the Northwest corner of the above described portion of said lot 86 conveyed to the City of Everett; thence Southeasterly to a point on the East line of said lot 86 that is 18 feet North of the Southwest corner thereof and the terminus of this description. be and the same is hereby vacated pursuant to the following conditions Section 2: The City of Everett, its successors or assigns shall not be responsible or liable for storm drainage runoff resulting from existing drainage patterns as established on City rights-of-way that may now or in the future go over, under, or across the above described street vacation.
