• <br /> • <br /> 1 ORDINANCE NO. &,/—7? <br /> 2 <br /> AN ORDINANCE prohibiting certain games of chance within the City of <br /> 3 Everett and providing penalties for the violation thereof. <br /> 4 <br /> 5 THE CITY OF EVERETT DOES ORDAIN: <br /> 6 Section 1: Winning at Play by Fraudulent Means - Every person who by the <br /> 7 game of "three-card montes' so called, or any other game, device, slight of hand, <br /> 8 pretensions to fortune telling, trick or other means whatsoever, by use of cards or other <br /> 9 implements or instruments, or while betting on sides or hands of any such play or game <br /> 10 fraudulently obtains from another person money or property of any description, shall be <br /> 11 punished as in the case of theft of property of like value. <br /> 12 Section 2: Manufacture, Sale or Use for Fraudulent Purposes of Any <br /> 13 Concession, Game of Skill or Chance is a criminal offense. <br /> 14 a. Every person who owns or operates any concession, and who fraudulently <br /> 15 obtains money from another by means of any hidden mechanical device or obstruction <br /> 16 with intent to diminish the chance of any patron to win a prize, or by any other <br /> 17 fraudulent means, shall be punished as in the case of theft of property of like value. <br /> 18 b. Any person who owns or operates any game at a fair or carnival of the <br /> 19 type known as "razzle-dazzle" shall be guilty of a Class A offense as defined in the City <br /> 20 of Everett Criminal Code. <br /> 21 c. As used in this section, "razzle-dazzle" means a series of games of skill or <br /> 22 chance in which the player pays money or other valuable consideration in return for <br /> 23 each opportunity to make successive attempts to obtain points by the use of dice, darts, <br /> 24 marbles or other implements, and where such points are accumulated in successive <br /> 25 games by the player toward a total number of points, determined by the operator, which <br /> 26 is required for the player to win a prize or other valuable consideration. <br /> 27 d. As used in this section, "concession" means any game or concession open <br /> 28 to the public and operated for profit in which the patron pays a fee for participating and <br /> 29 may receive a prize upon a latter happening. <br /> 30 <br /> 31 <br /> 32 <br />
