. <br /> 1 ORDINANCE NO. wen- 7 <br /> 2 <br /> 3 AN ORDINANCE providing for the vacation <br /> of the alley North of Main Street and West <br /> 4 of South 4th Avenue in Lowell. <br /> 5 ""EREAS, the City Council of the City of Everett did by Resolution <br /> 6 No. 1632 duly adopted and fix the 6th day of June, 1979, at 10:00 a.m., as the <br /> 7 date for public hearing; and <br /> 8 WHEREAS, due and legal notice of the time and place of said hearing <br /> 9 and determination of said Resolution has been given by the City Clerk in the manner <br /> 10 'rescribed by law; and <br /> 11 WHEREAS, at the time and place fixed for hearing favorable statements <br /> 12 :nd objections to the vacating of the herein described street were heard and <br /> 13 discussed; and <br /> 14 WHEREAS, it now appears to the City Council of the City of Everett <br /> 15 that the portion of said street resolved to be vacated should be vacated; <br /> 16 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> 17 Section 1: <br /> 18 That portion of the following described tract lying within the Northeast <br /> Quarter of the Northwest Quarter of Section 5, Township 28 North, <br /> 19 Range 5 E.W.M. and the Southeast Quarter of the Southwest Quarter <br /> of Section 32, Township 29 North, Range 5 E.W.M., described as follows: <br /> 20 <br /> Beginning at the Southwest corner of Block 17, Plat of Town of Lowell, <br /> 21 according to the plat thereof recorded in Volume 1, page 11, records <br /> of Snohomish County, Washington, thence Westerly along the North <br /> 22 line of Main Street, a distance of 200 feet to the true point of beginning; <br /> thence continuing in the same direction <br /> 23 a distance of 40 feet; thence angle right 90° <br /> a distance of 300 feet; thence angle right 90° <br /> 24 a distance of 20 feet; thence angle right 90° <br /> a distance of 140 feet; thence angle left 900 <br /> 25 a distance of 20 feet; thence angle right 900 <br /> a distance of 160 feet to the point of beginning. <br /> 26 <br /> Section 2: <br /> 27 <br /> The City of Everett, its successors or assigns shall not be responsible <br /> 28 or liable for storm drainage runoff resulting from existing drainage <br /> patterns as established on City rights-of-way that may now or in the <br /> 29 future go over, under, or across the above described street vacation. <br /> 30 <br /> 31 <br /> 32 <br />
