WHEREAS, the proposed regulations will not create a probable significant adverse <br /> environmental impact under the City's SEPA policies, EMC Chapter 20.04; and <br /> WHEREAS, the proposed amendments will ensure the titles of the EMC will be consistent with <br /> development regulations adopted to implement the Metro Everett Subarea Plan, Chapter 19, <br /> Metro Everett Uses and Chapter 20, Metro Everett and Core Residential Area Development <br /> Standards; and <br /> WHEREAS,the proposed amendments are consistent with the applicable provisions of the <br /> Everett general plan; and <br /> WHEREAS, the proposed amendments bear a substantial relation to public health, safety or <br /> welfare; and <br /> WHEREAS, the proposed amendments promote the best long term interests of the Everett <br /> community. <br /> NOW,THEREFORE,THE CITY OF EVERETT DOES ORDAIN: <br /> [Proposed changes are shown with a vertical bar in the left hand margin; words struck through are <br /> proposed for deletion; words that are underlined are proposed additions.] <br /> Section 1. Section 16 of Ordinance 1736-90, as amended, (Administration and Personnel, Planning <br /> Commission, Planning Commission appeals, EMC 2.20.160), is hereby repealed. <br /> Section 2. Section 17 of Ordinance 1736-90, as amended (Administration and Personnel, Planning <br /> Commission, Planning Commission Design review, EMC 2.20.170), is hereby repealed. <br /> Section 3. Section 7 of Ordinance 2347-98, as amended (Multifamily Housing Property Tax Exemption, <br /> EMC 3.78.070.D), is amended to read as follows: <br /> 3.78.070 Tax exemption for multifamily housing in residential targeted areas. <br /> D. Project Eligibility. A proposed project must meet the following requirements for consideration for a <br /> property tax exemption: <br /> 1. Location.The project must be located within the residential targeted area as designated pursuant to <br /> Section 3.78.150. <br /> 2. Tenant Displacement—Building Code Deficiency. <br /> a. Tenant Displacement. If the property proposed to be rehabilitated is not vacant prior to <br /> application, an applicant must provide each existing tenant housing of comparable size, quality, <br /> and price and a reasonable opportunity to relocate. <br /> b. Building Code Deficiency. Existing dwelling units proposed for rehabilitation must fail to comply <br /> with one or more requirements of the State Building Code as adopted by the city or the <br /> International Property Maintenance Code as adopted by the city as each are set forth in EMC <br /> Title 16. <br /> 3.
