#°1111Wooa <br /> ORDINANCE NO. 3618-18 <br /> An Ordinance Amending Streets and Sidewalks, Land Division and Zoning Regulations <br /> to be Consistent with New Development Regulations for Off-Street Parking and <br /> Loading,Amending Ordinances in Accordance with Sections 1-28 of this Ordinance <br /> WHEREAS,the Planning Commission recommended repeal and replacement of existing <br /> standards and development regulations in the Zoning Code for Parking, Loading and Access <br /> (Planning Commission Resolution No. 18-008); <br /> WHEREAS,the amendments to the Zoning Code will require additional amendments to Title 13, <br /> Streets and Sidewalks,Title 18, Land Division and Title 19,Zoning, of the EMC for consistency; <br /> WHEREAS,the Planning Commission conducted public briefings on March 7, 2018 and May 15, 2018,to <br /> discuss and consider potential amendments to titles of the EMC pertaining to consistency and <br /> coordination with new off-street parking standards and development regulations; <br /> WHEREAS, public notice and opportunity to comment on these amendments was provided through <br /> electronic and mail notice to interested parties, a legal notice of public hearing published in the Everett <br /> Herald on May 16, 2018, notice to the Washington State Department of Commerce on May 14, 2018, <br /> and a public hearing held by the Planning Commission on June 5, 2018; <br /> WHEREAS, EMC 19.41.170(C) provides for amendment of the Zoning Code (Title 19) when it finds that: <br /> 1) the proposed amendment is consistent with the applicable provisions of the Everett general plan; and <br /> 2) the proposed amendment bears a substantial relation to public health, safety or welfare; and 3)the <br /> proposed amendment promotes the best long term interests of the Everett community; <br /> WHEREAS, the proposed amendments will ensure the titles of the EMC will be consistent with the <br /> development regulations adopted to implement new off-street parking standards requirements; <br /> WHEREAS, the proposed amendments to the titles of the EMC are consistent with the city's <br /> Comprehensive Plan; <br /> WHEREAS,the proposed amendments to the titles of the EMC are consistent with the state's Growth <br /> Management Act; <br /> WHEREAS,the proposed off-street parking standards and development regulations bear a substantial <br /> relation to public health, safety or welfare; and <br /> WHEREAS,the proposed amendments promote the best long-term interests of the Everett community. <br /> Parking Amendments 1 8/29/18 <br />
