to EMC Chapter 19.34,the city engineer, in consultation with the planning director, may allow access <br /> from the street in-lieu, or in addition to, using the alley. <br /> G. No driveway approach for commercial purposes shall be allowed unless sufficient space is provided <br /> for vehicles,twenty feet in length to turn around before returning to the street, or unless an exit to an <br /> alley or secondary street is provided, or unless approved by the city council. <br /> Section 3. Section 11 of Ordinance No. 3498, Chapter 13.16, Driveways in Title 13 (Streets and <br /> Sidewalks, EMC 13.16.110) is hereby amended as follows: <br /> 13.16.110 Unusual conditions. <br /> The city council engineer is authorized to grant, in writing, variances administrative modifications from <br /> the regulations and requirements of this chapter, providing they first determine that the following <br /> conditions are presented the following criteria are met: <br /> A. The variance requestedmodification arises from peculiar physical conditions not ordinarily existing in <br /> similar districts in the city or is due to the nature of the business or operation upon the applicant's <br /> property; <br /> B. That the variance requestedmodification is not against the public interest, particularly safety, <br /> convenience and general welfare; <br /> C. That the granting of the permit for the v-ar-iancemodification will not adversely affect the rights of <br /> the adjacent property owners or tenants; <br /> D. That the terms of this chapter will create ammo-F-unnecessary hardship on the applicant, property <br /> owner or tenant. (Prior code § 13.36.110) <br /> Section 4. Section 7(F)(7) of Ordinance No. 2328-98, as amended (Land Division, Land Division <br /> Evaluation Criteria and Development Standards, EMC 18.28.120), is hereby amended as follows: <br /> 18.28.120 Easement access exception. <br /> A. Short Subdivisions. The city may, at the request of the applicant in short subdivisions only and as <br /> permitted by the Everett zoning code, allow access to lots by easement when in the opinion of the city <br /> engineer: <br /> 1. The improvement of a public street is not necessary to facilitate adequate supply of sewer and <br /> utilities; <br /> 2. The improvement of a public street is not necessary to provide on-street parking; <br /> 3. The improvement of a public street is not necessary to provide access to potential additional lots or <br /> future developable area; and <br /> 4. The improvement of a public street is not necessary to protect the public health, safety and welfare <br /> of the residents and general public. <br /> B. Subdivisions. When a site contains natural constraints, such as topography or environmentally <br /> sensitive areas, and the provision of an easement would reduce impacts to those areas, the director and <br /> city engineer may allow the use of limited easement access. Easement access within subdivisions shall <br /> be limited to one easement serving a maximum of two single-family units. <br /> C. Easement Access Drive Standards. All easement access drives shall be built to the following <br /> standards for easement widths, paving widths, off-street parking and utilities. All easement access drives <br /> shall be constructed to city standards with an A-1 curb/gutter on both sides and shall meet the <br /> Parking Amendments 3 8/29/18 <br />
