F. The County shall incarcerate detainees received from the City until one of the <br /> following occurs: <br /> i. Expiration of the term of confinement as indicated in a Warrant or <br /> Order of Commitment; or <br /> ii. Upon posting of bail; or <br /> iii. Upon receipt of a directive from a law enforcement officer <br /> (supervisory rank or higher) or prosecuting attorney of the City to <br /> release such person held under probable cause without judicial <br /> process; or <br /> Upon the passage of two (2) business days, for those held upon probable cause <br /> without judicial process; provided, prior to releasing any person pursuant to <br /> this subsection, the County shall attempt to contact the Everett Municipal <br /> Court to ascertain the Court's desire with regard to said person. <br /> 4. Housing and Programs <br /> A. It shall be the County's responsibility to confine the detainee; to supervise, <br /> discipline and control said detainee; take such steps as to necessary to safeguard <br /> the detainee's health and safety; and to administer the detainee's sentence <br /> pursuant to the order of the committing court in the State of Washington. <br /> B. The County will provide education and any other services to detainees in the same <br /> manner as it provides services to County detainees. <br /> C. City detainees will be subject to all programs, rules, rights, and privileges <br /> afforded the general population of County detainees, except when those rules are <br /> in conflict with this Agreement. When there is a conflict, this Agreement will <br /> supersede. <br /> D. The City will be responsible for additional costs associated with special staffing <br /> or programming that may be required by the need to mitigate any security <br /> management concerns of any City detainee. If such management concerns <br /> develop during a detainee's incarceration, the County will notify the City and give <br /> them the opportunity to remove or otherwise release the detainee from the facility. <br /> 5. Transportation <br /> A. Court - The City will be responsible for all scheduled transports to and from its <br /> Municipal Court, Probation Offices, or any other business related to criminal <br /> matters related to the youth's incarceration. <br /> 4 <br />
