7. Detention Alternatives <br /> The City may refer sentenced juvenile offenders not requiring secure detention and <br /> who are appropriate for intermediate sanctions to the County's detention alternatives <br /> (Youth Enrichment Services, YES) programs. Fees for placement in YES are <br /> outlined in Section III.1. <br /> 8. Detainee Access to Legal Assistance <br /> The City shall be responsible for responding to detainees' request for legal assistance <br /> or legal representation. If a City detainee makes a request for legal assistance or <br /> representation to a County Detention Officer, or elected or appointed official while <br /> detained in the detention facility, County shall make a reasonable opportunity <br /> available for the detainee to contact the detainee's legal counsel (if already <br /> represented) or shall notify the City of the detainee's request for counsel at the <br /> earliest opportunity. <br /> 9. Release from Detention <br /> A. Any City detainee shall be released, upon demand, to any City law enforcement <br /> officer (supervisory rank or higher). <br /> B. Any City detainee shall be released upon written direction or verified verbal <br /> direction of the City's Municipal Court or officer thereof. <br /> C. The County will hold all City detainees in accordance with the conditions outlined <br /> in the commitment order, bail order, or other order requiring detention. No <br /> detainee will be released until having satisfied the sentence, bail, or any other <br /> condition outlined in the court commitment or court order. <br /> D. Per DJJC policy and RCW 13.40.050(7) all detained youth are required to be <br /> released to the custody of a parent or legal guardian or other responsible adult as <br /> specified in the commitment order. The County will notify the City of any <br /> pending release where a parent or guardian is unavailable to take custody of a <br /> City detainee. The City agrees to take custody of any detainee whose parent or <br /> guardian is not available at time of release. <br /> 6 <br />
