CITY <br /> TASER PURCHASE,DISCLOSURE AND WAIVER AGREEMENT <br /> This7 aser Purchase,Disclosure and Waiver Agreement(this "Agreement") is dated as of <br /> 2018, and is by and between the CITY OF EVERETT (the"City") and <br /> ACCREDITED SECURITY, a Florida corporation("Purchaser"). <br /> RECITALS <br /> The City has determined that certain tasers are no longer suitable for City police use. The <br /> serial numbers(or other identifying information) for the tasers are attached(the tasers on the <br /> attached list,the"Tasers"). In accordance with the City's practices regarding surplus equipment, <br /> the City has determined to sell the Tasers to Purchaser. <br /> AGREEMENTS <br /> City and Purchaser agree as follows: <br /> 1. Purchaser Price. <br /> The City will sell the Tasers, and the Purchaser will purchase the Tasers. The purchase <br /> price is $200 for each working X26 Taser shipped with a quality duty holster with safety and <br /> $300 for each X2 Taser shipped with a quality duty holster with safety. Accredited will offer a <br /> reduced price for those not fully functioning or reparable. Purchaser will pay the purchase price <br /> for the Tasers by granting the City credit towards future purchases that the City makes from <br /> Purchaser. <br /> 2. Strictly AS-IS. <br /> PURCHASER AGREES THAT THE TASERS ARE <br /> SOLD STRICTLY "AS-IS" AND "WITH ALL FAULTS." <br /> PURCHASER UNDERSTANDS THAT ANY OR ALL OF <br /> THE TASERS COULD BE DANGEROUS, UNSAFE AND <br /> NOT IN WORKING ORDER. THE PURCHASER MUST <br /> INSPECT EACH TASER PRIOR TO USE TO DETERMINE <br /> WHETHER THE TASER IS IN WORKING ORDER AND <br /> SAFE. <br /> 3.
