1 <br /> ♦" s <br /> ORDINANCE NO. 5-4 7-7d <br /> AN ORDINANCE AMENDING SECTION 10 OF ORDINANCE 3292 AS AMENDED BY <br /> ORDINANCE 4070 OF THE EVERETT CITY CODE, REQUIRING A BUSINESS <br /> LICENSE FOR ENGAGING IN ANY BUSINESS ACTIVITY IN THE CITY OF EVERETT, <br /> ESTABLISHING A FEE FOR SUCH LICENSE, PROVIDING THAT SUCH LICENSE <br /> IS NOT TRANSFERABLE AND MAKING PROVISION FOR ThE SURRENDER OF <br /> SUCH LICENSE UPON TRANSFERRING PLACE OF BUSINESS OR WITHDRAWING <br /> FROM BUSINESS. <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: That Section 10 of Ordinance 3292 which reads as <br /> follows: <br /> SECTION 10: <br /> Business Licenses - required - fee - non-transferable. <br /> No person, whether subject to the payment of tax or not, shall <br /> engage in any, business or activity in the City of Everett for <br /> which a license fee or tax is imposed by this chapter without <br /> having first obtained and being a holder of a valid and subsist- <br /> ing license so to do, to be known as a "Business License" issued <br /> under the provisions of this chapter as hereinafter provided <br /> and without paying a license fee or tax imposed by this chapter. <br /> Any person, so engaging in a business activity within the City <br /> of Everett, whether taxable or not, shall apply for and obtain <br /> from the City Clerk, upon payment of a fee of $1. 00 , a "Business <br /> License" . Such applicant shall complete an application form for <br /> such "Business License" upon such forms as provided by the office <br /> of the City Clerk and shall accompany such application with the <br /> required fee. Such "Business License" shall be personal and non- <br /> transferable and shall be valid as long as the taxpayer continues <br /> in business and pays the tax accrued to the City of Everett. In <br /> case business is transacted by the applicant or licensee at <br /> two or more separate places by one taxpayer, a separate "Business <br /> License Certificate" for each place at which business is transacted <br /> with the public shall be required, but for such additional license <br /> or certificate no fee shall be required. Any person having a <br /> valid license under the provisions of this chapter for the year 1965 <br /> shall retain such license and the office of the City Clerk shall <br /> replace such license with a new certificate or "Business License" <br /> conditioned as in this section set forth, without charge. Each <br /> "Business License" shall be numbered and shall show the name, <br /> residence and place and character of business of the taxpayer and <br /> such other information as the office of the City Clerk deems <br /> necessary and shall be posted in a conspicuous place at the place <br /> of business for which it is issued.. When a place of business of <br /> the taxpayer is changed, the taxpayer must return to the office <br /> of the City Clerk the existing license or certificate and a new <br /> "Business License" will be issued for the new place of business <br /> free of charge. No person shall engage in any business taxable <br /> under this chapter without being registered in compliance with <br /> the provisions of the said chapter, except that the office of the <br /> City Clerk, by general regulation, may provide for the issuance <br /> of temporary certificates or licenses to temporary places of <br /> business without requiring the payment of any fee. <br /> No person to whom a license has been issued pursuant to this <br /> chapter shall suffer or allow any person for whom a separate <br /> license is required to operate under or to display his license; <br /> nor such other person operate under or display the license or <br /> certificate issued by the office of the City Clerk under this <br /> chapter to another taxpayer. <br /> -1- <br />
