I f <br /> r L t• <br /> •• • f� I •` • 1 ` • 1• • e • • r �' •• • • �; <br /> C13:1 ORDINANCE <br /> AN ORDINANCE amending Title 13 of the City Code <br /> to include construction of City streets to minimum <br /> standards with development/improvement of private <br /> property. <br /> WHEREAS, new developments contribute increased vehicular and pedestrian <br /> traffic volume on the surrounding City rights-of-way; and <br /> WHEREAS, the increased traffic volumes often contribute to unnecessary <br /> delay, increase traffic hazards, and reduce the quality of life in the City; <br /> and <br /> WHEREAS, the improvement to City rights-of-way to provide for pedestrians, <br /> vehicles and drainage would lessen the impact of new development on existing <br /> neighborhoods and on public services necessary to sustain the new development; <br /> and <br /> WHEREAS, improved rights-of-way are required to maintain the quality of <br /> life in Everett and provide for additional developments; and <br /> WHEREAS, owners and occupants of new developments derive benefits from <br /> said improvements; <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EVERETT, DOES <br /> ORDAIN: <br /> That Title 13 of the City Code is hereby amended by the addition <br /> of the following chapter: <br /> Section_1: Definitions <br /> For the purpose of this chapter the following definitions <br /> shall apply: <br /> A. "Alley" shall mean the minor portion of the public road network <br /> not designed for general travel and used primarily as means of <br /> access to the rear of residences and business establishments. <br /> B. "Alley improvement" shall mean the drainage, grading and <br /> pavement facilities required to improve the alley to City <br /> design standards. <br /> C. "City Engineer" shall mean the person appointed by the Mayor to <br /> position of Engineering Department Head, or his designee. <br /> D. "Right-of-Way" shall mean the public property used or reserved <br /> for municipal purposes including all public utilities and <br /> street usages. <br /> E. "Street" shall mean all or any portion of the City public road <br /> network open to the public for travel with exception of alleys <br /> and limited access highways designated as State Highways. <br /> F. "Street Improvements" shall mean the installation of all public <br /> facilities required to improve the street to City design standards <br /> including grading, drainage, pavement, curb/gutter, sidewalk, street <br /> lights, traffic signals and other necessary appurtenances. Such <br /> street improvements shall not be limited to the half street abutting <br /> the property; for example, where no permanent street improvement <br /> existed, the street improvement shall be extended beyond the <br /> centerline a sufficient distance (10 ft. minimum) to permit safe <br /> movement of traffic. <br /> -1- <br />
