AP' <br /> 1 thereby. All orders by the Board pursuant to this section shall include a report giving <br /> 2 findings of fact, conclusions, and its decision. <br /> 3 b. PROCEDURE. Any person who desires to file an appeal pursuant to the <br /> 4 provision set forth in this section shall file a written appeal to the secretary of the <br /> 5 Board and a filing fee of ten dollars ($10). The written appeal shall contain the <br /> 6 following information: <br /> 7 1. The names of all appellants participating in the appeal. <br /> 8 2. A brief statement of the specific action protested, together <br /> 9 with any material facts claimed to support the contentions of the <br /> 10 appellant. <br /> 11 3. A brief statement of the relief sought, and the reason why it <br /> 12 is claimed the protested action should be reversed, modified, or otherwise <br /> 13 set aside. <br /> 14 4. The signatures of all parties named as appellants and their <br /> 15 mailing addresses. <br /> 16 5. The verification (by declaration under penalty of perjury) of <br /> 17 at least one appellant as to the truth of the matters stated in the appeal. <br /> 18 i The Board shall fix a reasonable time for the hearing of the request for a <br /> 19 variance, give due notice thereof to the appellants and general public, and decide the <br /> 20 same within a reasonable time after the hearing. The final disposition by the Board <br /> 21 shall be in the form of an order and copies thereof shall be sent to the Administrator <br /> 22 and appellants. <br /> 23 c. BOARD OF ADJUSTMENT - VARIANCE CONSIDERATIONS. No <br /> variance in the provisions or requirements of this ordinance shall be authorized by the <br /> 24 <br /> 25 Board unless the Board finds that all of the following facts and conditions exist: <br /> 26 1. That there are exceptional or extraordinary circumstances <br /> 27 or conditions applying to the appellant's property, or as to the intended <br /> 28 use thereof, that do not apply generally to other properties in the same <br /> 29 noise control district. <br /> 30 <br /> 31 <br /> 32 Page -14- <br />
