AP' 1 thereby. All orders by the Board pursuant to this section shall include a report giving 2 findings of fact, conclusions, and its decision. 3 b. PROCEDURE. Any person who desires to file an appeal pursuant to the 4 provision set forth in this section shall file a written appeal to the secretary of the 5 Board and a filing fee of ten dollars ($10). The written appeal shall contain the 6 following information: 7 1. The names of all appellants participating in the appeal. 8 2. A brief statement of the specific action protested, together 9 with any material facts claimed to support the contentions of the 10 appellant. 11 3. A brief statement of the relief sought, and the reason why it 12 is claimed the protested action should be reversed, modified, or otherwise 13 set aside. 14 4. The signatures of all parties named as appellants and their 15 mailing addresses. 16 5. The verification (by declaration under penalty of perjury) of 17 at least one appellant as to the truth of the matters stated in the appeal. 18 i The Board shall fix a reasonable time for the hearing of the request for a 19 variance, give due notice thereof to the appellants and general public, and decide the 20 same within a reasonable time after the hearing. The final disposition by the Board 21 shall be in the form of an order and copies thereof shall be sent to the Administrator 22 and appellants. 23 c. BOARD OF ADJUSTMENT - VARIANCE CONSIDERATIONS. No variance in the provisions or requirements of this ordinance shall be authorized by the 24 25 Board unless the Board finds that all of the following facts and conditions exist: 26 1. That there are exceptional or extraordinary circumstances 27 or conditions applying to the appellant's property, or as to the intended 28 use thereof, that do not apply generally to other properties in the same 29 noise control district. 30 31 32 Page -14-
