1 (6) In the event that any such person seeking a review before the Fire <br /> Prevention Review Board fails to comply with all of the steps <br /> 2 herein set forth, then any member of said Fire Prevention Review <br /> Board or the City Attorney for the City of Everett may dismiss <br /> 3 such appeal upon motion and if all of the steps for appeal have not <br /> been complied with, the appeal of such party shall be dismissed by <br /> 4 the Fire Prevention Review Board. <br /> 5 (7) If such appeal is properly taken, the Fire Prevention Review Board <br /> shall, within seven days review such order and file their decision <br /> 6 thereon. All members of the Fire Prevention Review Board shall <br /> have a vote in arriving at such decision, except the Fire Chief, and <br /> 7 in the event such order is sustained by a majority of the Fire <br /> Prevention Review Board, it shall be forthwith complied with, or as <br /> 8 modified by the Fire Prevention Review Board if such modification <br /> order is entered. Unless by the authority of the Fire Prevention <br /> 9 Review Board such order is revoked or modified, it shall remain in <br /> full force and effect and be complied with within the time fixed in <br /> 10 said order or decision of the Fire Prevention Review Board. All <br /> decisions of the Fire Prevention Review Board shall be final. <br /> 11 <br /> Section 27. That Section 1.209 of the Uniform Fire Code be, and is hereby <br /> 12 <br /> deleting: <br /> 13 <br /> Whenever necessary to make an inspection to enforce any of the <br /> 14 provisions of this Code, or whenever the Chief or his authorized <br /> representative has reasonable cause to believe that there exists in any <br /> 15 building or upon any premises, any condition which makes such building or <br /> premises unsafe, the Chief or his authorized representative may enter <br /> 16 such building or premises at all reasonable times to inspect the same or to <br /> perform any duty imposed upon the Chief by this Code; provided that if <br /> 17 such building or premises be occupied, he shall first present proper <br /> credentials and demand entry; and if such building or premises be <br /> 18 unoccupied, he shall first make a reasonable effort to locate the owner or <br /> other persons having charge or control of the building or premises and <br /> 19 demand entry. If such entry is refused, the Chief or his authorized <br /> representative shall have recourse to every remedy provided by law to <br /> 20 secure entry. <br /> 21 "Authorized Representative" shall include the officers named in Sections <br /> 1.204, 1.205 and 1.206 of this Code. <br /> 22 <br /> No owner or occupant or any other person having charge, care or control <br /> 23 of any building or premises shall fail or neglect, after proper demand is <br /> made as herein provided, to properly permit entry therein by the Chief or <br /> 24 his authorized representative for the purpose of inspection and <br /> examination pursuant to this Code. Any person violating this subdivision <br /> 25 shall be guilty of a misdemeanor. <br /> 26 and inserting in its place: <br /> 27 Whenever necessary to make an inspection to enforce any provision of this <br /> ordinance, the Building Official or his authorized representative may <br /> 28 enter any building or premises as prescribed in Ordinance 315-74. <br /> 29 Section 28. That Section 1.215 of the Uniform Fire Code be, and is hereby <br /> 30 amended by deleting: <br /> 31 In order to determine the suitability of alternate materials and type of <br /> construction and to provide for reasonable interpretations of the <br /> 32 provisions of this Code, there shall be and hereby is created a Board of <br /> - 27 - <br />
