1 <br /> 2 ORDINANCE NO. -7/- <br /> 3 7T3 <br /> AN ORDINANCE amending Ordinance No. 446A-77, Section 115 (2) also <br /> 4 known as E.M.C. 10.68.020, to enable the City to collect delinquent <br /> library accounts receivables regardless of whether library materials <br /> 5 have been returned once the accounts are turned over to a private <br /> agency for collection. <br /> 6 <br /> 7 <br /> 8 WHEREAS, the collection of delinquent accounts on library materials has been a <br /> 9 constant financial concern to the City of Everett; and <br /> 10 WHEREAS, the amount of delinquent library accounts receivables between March <br /> 11 10, 1978, and May 10, 1978, which are due to be turned over for collection is $2,398.35; <br /> 12 and <br /> 13 WHEREAS, E.M.C. 10.68.020 provides for the time in which library materials <br /> 14 must be returned after notice has been sent to the borrower; and <br /> 15 WHEREAS, on April 28, 1978, the Library Board for the City of Everett passed a <br /> 16 motion reflecting the desire to collect delinquent library accounts receivables <br /> 17 regardless of whether library materials have been returned once the accounts are turned <br /> 18 over to a private agency for collection. <br /> 19 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> 20 Section 1: That E.M.C. 10.68.020 which reads as follows: <br /> 21 10.68.020 Retention after notice to return prohibited--Time limit. <br /> 22 It is unlawful to retain any book, newspaper, magazine, pamphlet, <br /> document, record, film, print, manuscript, or other property belonging to <br /> 23 or in, or on deposit with, the Everett Public Library, or any branch, <br /> reading room, deposit station, museum, or institution operated in <br /> 24 connection therewith for a period exceeding thirty days after the mailing <br /> by certified mail to the borrower's address on file with said library of a <br /> 25 notice in writing to return the same. Such notice shall be given after the <br /> expiration of time which, by the rules of the Everett Public Library, such <br /> 26 article or other property may be kept. Such notice so mailed shall bear on <br /> its face a copy of this section. <br /> 27 Be and the same is hereby amended to read as follows: <br /> 28 <br /> 29 <br /> 30 <br /> 31 <br /> 32 <br />
