ORDINANCE NO. 5/ - j1 <br /> AN ORDINANCE of the City of Everett, Washington <br /> establishing a new chapter of the Everett Municipal <br /> Code covering drainage and requiring a drainage plan <br /> to be submitted in conjunction with certain applica- <br /> 1 tions for permits, specifying the contents thereof, <br /> requiring surety and cash bonds and authorizing City <br /> 2 assumption of drainage facilities. <br /> 3 <br /> 4 <br /> WHEREAS, an expanding population and increased development of land, <br /> 5 coupled with inadequate drainage controls, has led to drainage and runoff <br /> 6 problems, and <br /> 7 WHEREAS, these drainage and runoff problems contribute to increased <br /> 8 sedimentation in the ponds, creeks, and streams, thereby degrading water <br /> 9 1 quality, and <br /> 10 WHEREAS, these drainage and runoff problems also contribute to water <br /> 11 ( quality degradation through excessive discharge of nutrients, metals, oil <br /> 12 11 and grease, toxic materials, and other detrimental substances, and <br /> li <br /> 13 11 WHEREAS, inadequate surface and subsurface drainage planning and <br /> Ii <br /> 14 11 practices lead to erosion and property damage, and risk to life, and <br /> 15 WHEREAS, excess water runoff on streets and highways poses a safety <br /> 16 i hazard to both lives and property, and <br /> 17 WHEREAS, the City Council finds that future problems could be avoided <br /> 18 if developers, both private and public, provide for adequate drainage of <br /> 19 their property, now, therefore, <br /> 20 THE CITY COUNCIL OF THE CITY OF EVERETT, WASHINGTON, DOES ORDAIN <br /> 21 AS FOLLOWS: <br /> 22 There is hereby created a new Chapter of the Everett Municipal Code <br /> 23 (EMC) entitled "Surface and Storm Drainage." <br /> 24 Section 1: Purposes <br /> 25 The City Council finds that this Chapter is necessary in order to <br /> 26 promote sound development guidelines and construction procedures which <br /> 27 respect and preserve the City's water courses; to minimize water quality <br /> 28 degradation and control the sedimentation of creeks, streams, ponds, lakes <br /> 29 and other water bodies; to protect property owers adjacent to developing <br /> 30 and developed land from increased runoff rates which could cause erosion of <br /> 31 abutting property; to protect downstream owners; to preserve and enhance <br /> 32 <br /> 1 <br /> i I I <br />
