ORDINANCE NO. 19 - 'd AN ORDINANCE relating to and regulating the use of privately owned burglar and/or robbery alarm systems; defining false alarms and offenses in connection therewith; prescribing fees and penalties. THE CITY OF EVERETT DOES ORDAIN: Section 1: Filing of Emergency Response Card; Contents - It is unlawful to have or maintain on any premises a burglary and/or robbery alarm unless there is on file with the Everett Police Department Communication Center, an emergency response card containing the names of persons authorized to enter such premises and turn off any alarm and current tele- phone numbers at which such persons can be reached at all times . It is unlawful for any such authorized person to fail to appear and turn off any such alarm as soon as pos- sible, but not later than one hour after being notified by the police to do so. Section 2 : It is unlawful for anyone to activate any robbery or burglary alarm for the purpose of summoning police except in the event of actual or attempted burglary or rob- bery, or for anyone notifying the police of an activated alarm and having knowledge that such activation was appa- rently caused by an electrical or other malfunction of the alarm system to fail at the same time to notify the police of such apparent malfunction. Section 3: A. For the purposes of this section, the term "false alarm" shall mean the activation of a burglary and/or robbery alarm by other than forced entry or attempted forced entry to the premises at a time when no burglary or robbery is being com- mitted or attempted on the premises.
