ORDINANCE NO. i"7f- 77 <br /> AN ORDINANCE amending Ordinance No. 295-74, also known as EMC <br /> Chapter 5.12; simplifying and redefining the names and types of <br /> licenses, eliminating restrictions on the number and type of licenses <br /> issued; creating a more efficient machine identification and location <br /> scheme; making the license year consistent with general licensing <br /> 1 provisions; and providing for greater enforcement capabilities. <br /> 2 <br /> 3 <br /> 4 WHEREAS, the City of Everett feels it incumbent to exercise its police powers <br /> 5 in the regulation of amusement devices; and <br /> 6 WHEREAS, the City of Everett feels it incumbent to redefine, consolidate, and <br /> 7 avoid confusion between types of licenses issued by the City; and <br /> 8 WHEREAS, the City of Everett feels it necessary to foster more competition in <br /> 9 the amusement device business; and <br /> 10 WHEREAS, the City of Everett feels it incumbent to obtain up-to-date, accurate <br /> 11 records of the location of each amusement device licensed in the City; and <br /> 12 WHEREAS, the Police Department and the City of Everett feels it impractical to <br /> 13 enforce regulations relating to licensing of wholesale distributors of amusement <br /> 14 devices; and <br /> 15 WHEREAS, the Licensing Department and the City of Everett feels it necessary <br /> 16 to make the license year for amusement devices consistent with the general licensing <br /> 17 provisions; and <br /> 18 WHEREAS, the Police Department, City Clerk's Office, and the City of Everett <br /> 19 feels it incumbent to exercise its police powers in enforcing this Chapter and setting <br /> 20 penalties for violations thereof; <br /> 21 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> 22 Section 1: That EMC 5.12.010 which reads as follows: <br /> 23 5.12.010 Definitions. <br /> 24 A. "Amusement arcade" means a place where twenty or more coin <br /> 25 operated amusement devices are exhibited for. play and where <br /> vending machines, weight lifting devices, shuffleboards, scales, <br /> 26 punching bags, mechanical music machines, amusement rides, <br /> shooting galleries or similar devices are exhibited or exposed for <br /> 27 play or use by the public. <br /> 28 B. "Amusement device" means any machine or device designed to be <br /> operated to use for playing a game upon the insertion of a coin, <br /> trade check or slug, as hereinafter provided, and which is played or <br /> 29 operated only for amusement and entertainment, and will include <br /> the following: shuffleboards, mechanical music machines, pool <br /> 30 tables, flipper games, baseball machines, bowling games, guns and <br /> rifles, riding devices for not more than two persons, panorama or <br /> 31 <br /> 32 <br />
