• <br /> Y , <br /> ORDINANCE NO. 7 0 - -7 7 <br /> AN ORDINANCE amending the Model Traffic Ordinance, No. 459-77, to <br /> include impoundment procedure for parking violations, administrative <br /> appeal of parking notices, trains obstructing traffic, violations for <br /> trains obstructing traffic, speed limits for trains, exceeding speed <br /> 1 limits, City Treasurer's authority in relation to delinquent parking <br /> accounts and unnecessary motor noise prohibited. <br /> 2 <br /> 3 <br /> 4 WHEREAS, the Model Traffic Ordinance, No. 459-77, was adopted by the City of <br /> 5 Everett; and <br /> 6 WHEREAS, the City Council finds that any vehicle parked in any parking space <br /> 7 beyond the time established for the parking zone or the time authorized for use of a <br /> 8 parking meter obstructs the free use of such parking space by the general public for <br /> 9 such limited parking purpose and thus constitutes a public nuisance; and <br /> 10 WHEREAS, the City Council finds that any person who upon receipt of a notice <br /> 11 of parking violation feels he has been unjustly accused of violating a parking ordinance <br /> 12 of the City of Everett shall be able to state his disagreement and reasons therefor to <br /> 13 the City Treasurer, or such other official as shall be designated; and <br /> 14 WHEREAS, the City Council finds it is unlawful to permit a train to obstruct <br /> 15 traffic for more than ten (10) minutes; and <br /> 16 WHEREAS, the City Council finds that any conductor, engineer, or brakeman in <br /> 17 charge of any train or railroad car permitting it to obstruct traffic for more than ten <br /> 18 (10) minutes shall be punished by a fine or imprisonment, or both; and <br /> 19 WHEREAS, the City Council finds it to be unlawful to operate any locomotive or <br /> 20 train over, along, or across any street in excess of prescribed speeds; and <br /> 21 WHEREAS, the City Council finds every person violating the prescribed speed <br /> 22 provisions for trains shall be guilty of a misdemeanor and upon conviction, pay a fine or <br /> 23 imprisonment, or both. <br /> 24 WHEREAS, the City Council finds it necessary to authorize the City Treasurer to <br /> 25 turn over delinquent parking accounts to collection agencies; and <br /> 26 WHEREAS, the City Council finds it unlawful for any person to "tune up" or <br /> 27 "race" the engine of any motor vehicle on any street; <br /> 28 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> 29 Section 1: The Model Traffic Ordinance, No. 459-77, is hereby amended by the <br /> 30 addition of the following sections: <br /> 31 <br /> 32 <br />
