• <br /> --(9) "Element of an offense" means (i) such conduct or (ii) <br /> --such attendant circumstances, or (iii) such a result of <br /> rconduct as: <br /> • (a) is included in the description of the forbidden <br /> conduct in the definition of the offense; or <br /> - (b) establishes the required kind of culpability; or <br /> • ~(c) negates an-excuse or justification for such conduct; <br /> or • <br /> (d) negates a defense under the statute of limitations; <br /> or <br /> :.(e) establishes jurisdiction; . <br /> 410) "Forcible felony" means any felony which involves the 'use. <br /> .or threat of physical force or violence against any person; • <br /> 7-(11) "judger includes every judicial officer authorized, alone <br /> -„or-with others , to hold or preside over a court; • <br /> -(12) "Material element of an offense” means an element that does <br /> —not relate exclusively to the statute of limitations , jurisdiction <br /> --or-to any other matter similarly unconnected with (i.) the harm <br /> or•evi.l, incident to conduct, sought to be prevented by the law <br /> refining the offense, or (ii) the existence of a justification <br /> 4or excuse for such conduct; <br /> -413) -"Motor vehicle" means every- vehicle which is self-propelled <br /> -=or, propelled by eiectirc power obtained from overhead <br /> --Volley wires; <br /> ;(14) "Officer" and "public officer" has its ordinary meaning and <br /> .inclludes all assistants , deputies , clerks and employees of <br /> Aly public officer and all persons exercising or assuming <br /> -to exercise any of the powers or functions of a.public officer; <br /> (15) "Omission" means a failure to act; <br /> (16) "Ordinance" means the Charter of the City or an act of the <br /> City Council; <br />
