Section 61: Theft <br /> 1. A person is guilty of theft if: <br /> a. he steals the property of another of value of <br /> $250 or less; or <br /> b. by deception or by other means to avoid payment <br /> for services, he intentionally obtains services <br /> which he knows to be available only for <br /> compensation or value of $250 or less; or <br /> c. having control over the disposition of services of <br /> others to which he is not entitled; he knowingly <br /> diverts those services of value of $250 or less to <br /> his own benefit or to the benefit of another not <br /> entitled thereto. <br /> 2. In any prosecution under this Section 61, it is an affirmative <br /> defense that the property or services were openly obtained <br /> under a claim of title made in good faith, even though the <br /> claim be untenable. <br /> 3. Theft is a Class A offense. <br />
