Section 76 Failure to Disperse <br /> 1. As used in Paragraph 2 of this Section 76 of Article 10 , <br /> "public safety order" is an order issued by a peace officer <br /> designed and reasonably necessary to prevent or control a <br /> serious disorder and promote the safety of persons or property. <br /> No such order shall apply to a news reporter or other person <br /> observing or recording the events on behalf of the public <br /> press or other news media, unless he is physically obstruct- <br /> ing lawful efforts by such officer to disperse the group. <br /> 2. A person is guilty of failure to disperse if : <br /> (a) he congregates with a group of four or more other <br /> persons and there are acts of conduct within <br /> that group which create a substantial risk of causing <br /> injury to any person or substantial harm to <br /> property; and <br /> (b) he refuses or intentionally fails to obey a public <br /> safety order to move, disperse or refrain from speci- , <br /> fied activities in the immediate vicinity. <br /> 3 . Failure to disperse is a Class B offense. <br />
