• <br /> • <br /> • <br /> _Section 5 Punishment of Offenses • <br /> • <br /> .(1) A Class A offense may be punished by a fine not to exceed <br /> • :Five Hundred Dollars ($500.00) or imprisonment in jail <br /> -not to exceed six (6) months , or both imprisonment and <br /> -:_(2) ;-A Class B offense may be punished by a-fine not to exceed <br /> . --.Tufo Hundred Dollars ($200.00) or imprisonment in jail not <br /> -do exceed ten (10) days , or both fine and imprisonment; <br /> • t.provided, however that a Class B offense shall be punished <br /> -by a fine only (not to exceed Two Hundred Dollars ($200.00) <br /> • •.:if`rhe defendant has not been convicted of, pled guilty or <br /> forfeited to a Class A or B offense of the City of Everett <br /> - three (3) years immediately preceding his or her <br /> .rrest-on the Class B offense which disposition is currently <br /> .to be determined. Provided, further , that for the limited <br /> :::purposes•of sentencing under this subsection of Section. 5, <br /> >a conviction for, plea of guilty or forfeiture to a mis- <br /> demeanor (excluding traffic offenses) committed within <br /> ,the City of Everett prior to the effective- date of. this Code, <br /> • -shall be considered a Class A or B offense. <br /> • 43) A-violation may be punished by a fine or forfeiture not to <br /> - .exceed Five Hundred Dollars ($500.00) , but a com.;ietion <br /> --= f a violation shall not give use to any dis&iIity or legal <br /> • _<rdisadvantage based on the conviction of a criminal offense. <br /> :Nothing herein this Section 5 or otherwise in this Code <br /> shall be construed to restrict, diminish or inhibit the <br /> -court`s discretionary power to treat any intentional <br /> --failure to comply with a court order in respect to fines <br /> --or costs or both upon a conviction, as contempt. <br /> (5) -tor the purposes of subsection 2 of this Section 5, proof <br /> =of a prior conviction, plea of guilty or forfeiture may be <br /> ---established by a certified copy of that portion of the <br /> -previous court record which reflects dispositicn. Except <br /> -as otherwise provided by the rules of evidence , this <br /> evidence shall not be offered to the court until a finding <br /> .of guilt has been entered and is to be used for the limited <br /> -purpose of sentencing. <br />
