Section 78 Esta t <br /> 1. A person commits the offense of Escape if: • <br /> (a) He or she escapes from custody; or <br /> (b) He or she uses or threatens to use physical force <br /> ,escaping from custody. <br /> • <br /> 2. For the purposes of this Section 78 of Article 11, the :c .lowing <br /> --definitions shall apply: <br /> .(a) "Custody" means the imposition of actual or <br /> =constructive restraint by a peace officer <br /> .pursuant to a court order or arrest. <br /> _(b) -"Escape" means the unlawful departure of a person <br /> from custody or a correctional facility, or failure <br /> ,to return to custody following temporary leave <br /> • anted for a specified purpose or limited period. <br /> • <br /> 3.
