x '773 - 73 (W.o. ) 5.39 ORDINANCE NO. 4 V/- 77 AN ORDINANCE providing for the vacation of the alley west of State Street between 17th and 18th Street. WHEREAS, by Resolution No. 1247 of the City of Everett, the City Council has declared its intention to vacate said right-of-way; and WHEREAS, the City Council of the City of Everett did by resolution duly adopted, fixed the 2nd day of March, 1977, at 10:00 a.m. of said day for the hearing and determination of said resolution; and WHEREAS, due and legal notice of the time and place of said hearing and determination of said resolution has been given out in the manner prescribed; and WHEREAS, at the time and place fixed for hearing favorable statements and objections to the vacating of the herein described right-of-way were heard and discussed; and WHEREAS, it now appears to the City Council of the City of Everett, that the portion of said right-of-way resolve to be vacated shall be vacated; NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: Beginning at the northeast corner of Lot 1, Block 397, Plat of Riverdale Add; thence west along the north line of said Lot 1 a distance of 4.0 feet; thence southerly parallel to the east line of Lots 1 through 16 to the south line of said Lot 16; thence easterly along the south line of said Lot 16 and its easterly projection a distance of 24.0 feet to a point on the south line of Lot 17 that is 4.0 feet east of the southeast corner thereof; thence north parallel to the west line of Lots 17 through 32 to the north line of Lot 32; thence west along the north line of said Lot 32 and its westerly projection a distance of 20.0 feet to the true point of beginning, and the same is hereby vacated. Section 2: The City of Everett, its successors or assigns shall not be responsible or liable for storm drainage runoff resulting from existing drainage patterns as established on City rights-of-way that may now or in the future go over, under, or across the above described street vacation.
