x '773 - 73 (W.o. ) <br /> 5.39 <br /> ORDINANCE NO. 4 V/- 77 <br /> AN ORDINANCE providing for the vacation of <br /> the alley west of State Street between 17th <br /> and 18th Street. <br /> WHEREAS, by Resolution No. 1247 of the City of Everett, the City <br /> Council has declared its intention to vacate said right-of-way; and <br /> WHEREAS, the City Council of the City of Everett did by resolution <br /> duly adopted, fixed the 2nd day of March, 1977, at 10:00 a.m. of said <br /> day for the hearing and determination of said resolution; and <br /> WHEREAS, due and legal notice of the time and place of said hearing <br /> and determination of said resolution has been given out in the manner <br /> prescribed; and <br /> WHEREAS, at the time and place fixed for hearing favorable statements <br /> and objections to the vacating of the herein described right-of-way were <br /> heard and discussed; and <br /> WHEREAS, it now appears to the City Council of the City of Everett, <br /> that the portion of said right-of-way resolve to be vacated shall be vacated; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: <br /> Beginning at the northeast corner of Lot 1, Block 397, <br /> Plat of Riverdale Add; thence west along the north line <br /> of said Lot 1 a distance of 4.0 feet; thence southerly <br /> parallel to the east line of Lots 1 through 16 to the <br /> south line of said Lot 16; thence easterly along the south <br /> line of said Lot 16 and its easterly projection a <br /> distance of 24.0 feet to a point on the south line of <br /> Lot 17 that is 4.0 feet east of the southeast corner <br /> thereof; thence north parallel to the west line of Lots 17 <br /> through 32 to the north line of Lot 32; thence west along <br /> the north line of said Lot 32 and its westerly projection <br /> a distance of 20.0 feet to the true point of beginning, <br /> and the same is hereby vacated. <br /> Section 2: <br /> The City of Everett, its successors or assigns shall not be <br /> responsible or liable for storm drainage runoff resulting <br /> from existing drainage patterns as established on City <br /> rights-of-way that may now or in the future go over, under, <br /> or across the above described street vacation. <br />
