ORDINANCE NO. RI/Mr <br /> AN ORDINANCE relating to the Operating Hours of City Parks, amending <br /> Ordinance 3059-08 (EMC 9.06.208.B) <br /> WHEREAS, <br /> A. Section 1 of Ordinance 3059-08 (EMC 9.06.208)in part states that "[u]nless <br /> otherwise posted, city parks are open to the public from six a.m. to ten p.m.April <br /> 1st to October 31st and six a.m. to eight p.m.November lst to March 31st." <br /> B. Services offered by the City of Everett Parks and Community Services <br /> Department include activities and events where customers are in City parks past <br /> these times <br /> C. Efficient operations and management of City parks can be improved through the <br /> establishment and posting of park operating hours. <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1 <br /> Section 1 of Ordinance 3059-08 (as amended) is amended as follows, with <br /> underlines added and strikeouts deleted: <br /> Unless otherwise posted, city parks are open to the public from six a.m. to dusk <br /> six a.m. to ten p.m. April 1 to October 31'and six a.m.to eight p.m.November <br /> �St to March 31$t. Dusk is defined as 30 minutes after sunet. The parks are <br /> closed to public outside of posted times. The parks and recreation director shall <br /> have the authority to modify the time a city park is open and closed to the public <br /> where the director determines it appropriate. <br /> Section 2 <br /> The City Council hereby declares that should any section,paragraph, sentence, clause or <br /> phrase of this ordinance be declared invalid for any reason, it is the intent of the City <br /> Council that it would have passed all portions of this ordinance independent of the <br /> elimination of any such portion as may be declared invalid. <br /> 22 <br />
