1 (W.O.1275) <br /> 1 <br /> ORDINANCE NO. L14. ° 7,4 <br /> AN ORDINANCE PROVIDING FOR THE VACATION OF A <br /> PORTION OF 9TH STREET ADJACENT TO LOT 18, <br /> BLOCK 163, AND LOT 34, BLOCK 180, SWALLWELL'S <br /> FOURTH ADDITION. <br /> WHEREAS, by Resolution No. jq'/6 of the City of Everett, the City <br /> Council has declared its intention to vacate said right-of-way; and <br /> WHEREAS, the City Council of the City of Everett did by resolution <br /> duly adopted, fixed the 17th day of November, 1976, at 7:00 p.m. of said <br /> day for the hearing and determination of said resolution; and <br /> WHEREAS, due and legal notice of the time and place of said hearing <br /> and determination of said resolution has been given out in the manner <br /> prescribed; and <br /> WHEREAS, at the time and place fixed for hearing favorable statements <br /> and objections to the vacating of the herein described right-of-way were <br /> heard and discussed; and <br /> WHEREAS, it now appears to the City Council of the City of Everett, <br /> that the portion of said right-of-way resolve to be vacated shall be vacated; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: <br /> That portion of 9th Street adjacent to Lot 18, Block 163, and <br /> Lot 34, Block 180, Swallwell's Fourth Addition be and the <br /> same is hereby vacated. <br /> Section 2: <br /> The City of Everett, it <br /> (s successors or assigns shall not be <br /> responsible or liable f r storm drainage runoff resulting <br /> from existing drainage patterns as established on City <br /> rights-of-way that may now or in the future go over, under, <br /> or across the above described street vacation. <br /> Section 3: <br /> The City of Everett reserves and retains an easement over, <br /> under, and across said land to construct, operate, replace, <br /> repair and maintain all utilities of the City of Everett <br /> including but not limited to water, sewer, and drainage, <br /> and does further hereby reserve private utilities the right <br /> to construct, operate, replace and repair all utility <br /> services including but not limited to gas, electricity, and <br /> telephone. <br />
