First, it is to provide the City of Everett, WA with design plans for improvements being made by Amtrak to the Station's public address system. This project involves the installation of a Passenger Information Display System known as "PIDS". This system will provide both visual and audible information to rail passengers in the Station building and on the platform and will meet the requirements of the ADA. The PIDS plans have progressed to the 100%level of design and are enclosed with this letter for your review,since the improvements impact property owned by the City of Everett,WA. The second purpose of this letter is to provide Amtrak's notice under section 11 of the Lease Agreement between The National Railroad Passenger Corporation and the City of Everett, WA("Lease Agreement") of the planned improvements and to request that City of Everett, WA: (i) consent to the making of the improvements to City of Everett, WA property substantially in accordance with the Plans; (ii) agree to provide Amtrak and its contractors access to City of Everett, WA property at the time the improvements are to be made;(iii)agree that City of Everett,WA will timely sign any related documentation that may be required for Amtrak and its contractors to complete the project; (iv)confirm that the PIDS system will be owned by Amtrak before and after installation and may be removed by Amtrak at any time and at Amtrak's sole discretion during the term of the lease or at the time of surrender; (v) agree that City of Everett, WA will not remove or in any way alter the PIDS improvements for as long as Amtrak uses or intends to use the improvements in providing passenger rail services at the Station, without the prior written consent of Amtrak; and (vi) agree that City of Everett, WA will provide Amtrak with continued access to the improvements and will ensure Amtrak's perpetual right to use, maintain, repair and replace the improvements for as long as Amtrak provides or intends to provide passenger rail services at the Station. Your signature below constitutes City of Everett, WA consent to the improvements substantially in accordance with the Plans,consent for Amtrak and its contractors to proceed with the improvements, and City of Everett, WA agreement to comply with all of Amtrak's other requests for City of Everett, WA agreement and confirmation as described in the above paragraph.
