Section 1 of Ordinance 3059-08 (EMC 9.06.208) in part states that "[u]nless otherwise posted, city parks are open to the public from six a.m. to ten p.m. April 1st to October 31' and six a.m. to eight p.m. November 1st to March 31St " B. Services offered by the City of Everett Parks and Community Services Department include activities and events where customers are in City parks past these times C. Efficient operations and management of City parks can be improved through the establishment and posting of park operating hours. NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1 Section 1 of Ordinance 3059-08 (as amended) is amended as follows, with underlines added and strikeouts deleted: Unless otherwise posted, city parks are open to the public from six a.m. to dusk six a.m. to ten p.m. April 1St to October 31'and six a.m. to eight p.m. November }St to March 31st. Dusk is defined as 30 minutes after sunset. The parks are closed to public outside of posted times. The parks and recreation director shall have the authority to modify the time a city park is open and closed to the public where the director determines it appropriate. Section 2 The City Council hereby declares that should any section, paragraph, sentence, clause or phrase of this ordinance be declared invalid for any reason, it is the intent of the City Council that it would have passed all portions of this ordinance independent of the elimination of any such portion as may be declared invalid.
