RESOLUTION NO. <br /> A RESOLUTION authorizing the declaration of <br /> certain City owned properties as surplus and <br /> authorizing the sale and disposition of those properties. <br /> WHEREAS, a review of certain properties owned by the City for surplus as described in <br /> Exhibit A, attached hereto and incorporated herein by reference, has been completed by <br /> all City Departments and has received approval of the Mayor; and <br /> WHEREAS, in accordance with RCW 35.94.040 the City of Everett did hold a public <br /> hearing on November 14, 2018, regarding the proposed surplus of City owned properties, <br /> some of which were originally purchased for utility purposes; and <br /> WHEREAS, the Everett City Council finds and determines that the real property <br /> described in Exhibit A, is not and will not be needed for City purposes and is therefore, <br /> declared to be surplus; and <br /> WHEREAS, the Everett City Council fmds that the City is acting in compliance with the <br /> City Charter and the requirements of Ordinance No. 2935-06 establishing the process for <br /> sale of City owned real property except as provided for herein; <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br /> CITY OF EVERETT as follows: <br /> Section 1: The real property described in Exhibit A is not and will notbe needed for City <br /> purposes, and is,therefore, declared to be surplus property. <br /> Section 2: The real property described in Exhibit A shall be sold on the following <br /> conditions: <br /> a) No property shall be sold for less than 100% of the market value as established by <br /> written independent appraisal for the property or for such other reasonable and lawful <br /> terms and conditions the City determines to be in the best interests of the City; and <br /> b) Some or all of the properties may be marketed and listed for sale with a licensed <br /> real estate broker as selected by the City upon terms of agreement for such services and <br /> City Council approval of such terms of agreement; and <br /> c) Some or all of the properties may be marketed and listed for sale by City staff; and <br /> d) The disposition of the real property described in Exhibit A is to be done in a <br /> commercially reasonable manner as determined by the Mayor or her designee; and <br /> 2 <br />
